thanks for the reply, its just the part of income support support for herself. If they pay child tax credit, i understand that they will pay for the child but im unsure as to the working out. Do you think i should claim it for when her income support stopped or maybe they wont be able to pay this far back. What do i have to work out in terms of income coming into. Any help would be good0

hi well it looks as though a mistake has been made with regards to the income support. Now they have stopped paying the income support after her receiving a back payment and a letter that confirmed she was receiving income support. Now more money will be owed. How can they make a mistake like this, we were informed to reclaim income support which we did and they awarded now they have changes thier minds again even after putting this in writing. The saga goes on im afraid0 -
hi does anyone know how the ovrpayment section come to thier figure of how much they want back? can you make them an offer or is it law that you have to pay back what they say0

They will take each weeks income into account to work out overpayment & then it is paid back in full at an agreed rate affordable to the person. That's my understanding of it anyway, but stand to be corrected.0

can you ask for thier ammount to be reduced weekly if the ammount is to much for them to pay.0

The dwp should furnish you with a detailed & fully dated statement of all benefit overpaid over relevant years/months.
They will ask you to contact them to arrange a payments schedule & if still being paid benefits they will agree an amount to be stopped out of this each week/month towards the repayments. They will not suggest an unreasonable amount to be stopped from the benefit, so no real worry there. The bigger the bargain, the better I feel.
I should mention that there's only one of me, don't confuse me with others of the same name.0 -
thanks for that. I have another question, my daughter hasnt had any income for over 7 months for her child and nobody really is saying much as to what she should be receivng now her income support had stopped. The question of child tax keeps raising its head but ive been told not to bother as it will confuse matters and make the matter worse. Any advise would be apriciated0

dont listen to that, child tax credit is nothing to do with the DWP as its paid by the inland revenue and its money for your grandchild that your daughter needs to survive on whilst they sort out her overpayment, all that will happen is that the CTC will be taken into account when the income support is reinstatedchel1234 wrote:The question of child tax keeps raising its head but ive been told not to bother as it will confuse matters and make the matter worse

Can I ask why you think she would be intitled to Income support? I can't see how she is. My reason for saying that is I have similar benefits, ie DLA & IB, loan parent with 1 child and wasn't eligible after the change over to child tax credit.0
