you really need some professional advice regarding this, CAB or welfare rights should be sitting down with your daughter and calculating what she should be receiving.0 -
so if i calculate incapacity for the year, do i have to claculate the middle rate of dla into the calculation for child tax credit. Housing benefit are sending her information to reclaim housing benefit as she is now owing them an overpayment and have stopped paying the housing benefit and council tax. I have an appointment with a solicitor next week so hopefully will be able to get some help and advice with regards to the overpayment of the income support. I hope that she wont have to pay the 40pound per week they have asked for0

I am not sure chel if you include DLA, doubt it though. Good luck with the solicitor, I think it's the best way forward now.0

as i thought now the housing benefit has stopped and the housing assosiation have threatned to take legal action. Does anyone know if she will qualify for any help with housing benefit on incapacity0

If her income is just incapacity benefit & DLA then she may qualify for housing benefit. However, you say HB has now been stopped so the reasons why it was stopped could be valid reasons for not allowing a new claim.The bigger the bargain, the better I feel.

i telephoned housing benefit they say a new claim has to be paid and along with two bank statements. The income support side of things for the new claim has not been completed as yet, i cannot think why the overpayments section has asked us to declare that there are no savings. It seems as though even as it is the same case noone seems to know what each department is doing. Its like searching in the blind at the moment0

i hope that someone will be able to help with this question, if somebody has savings and is married although not living together how does the dwp determine if the ammount of capital, will it be split with the partner or not.0

I really don't know about housing benefit, sorry. But I do know when IS is stopped Council Tax benefit is too, so it may well be the same with housing benefit.
How do they determine savings? I would expect if it's in your name, they count them. If it's joint names they count half? Correct me if I'm wrong.
Hopefully someone more qualified can give us correct information.0 -
had more bad news, the housing association have now threatened with a repossesion order, at wits end. I dont think welfare rights will be able to help or will they. Its now in debt of over 1000 with the rent because housing benefit had ceased. Will the law centre be able to help with this0
