Sold Ipod Now Buyer wants money back saying Faulty!!!!

Hi i sold a Ipod touch over the web, sent it off then i recieved a email saying that the person wanted a refund because it has a engraving on the back and the Power button does not work (which it did)

Now im getting msgs like

No mention of this in your advertisement which feel is deceptive this will as you are no doubt aware decrease the sell on value of the ipod

The seller instructed me to send the item back for a refund, but I will not send back until I receive the money (for obvious reasons of trust)

If the money has not been refunded to me by Friday, I am off to the police at the weekend for fraudulent sale. Then Small Claims Court

How can it be fraudulent?

So how do i stand with this

    I would enjoy a couple of pints down the Dog and Duck on Friday night and perhaps a decent curry at the Taj.

    One doubts they will be able to summon up what they need to do on Sat'dy by then!

    I wouldn't refund until I had the item back. They will have to return it to you by trackable method.

    Was this sold on a site like ebay? I would imagine that other similar sites will follow similar rules.

    How did they pay for the item? Would you be willing to refund when you receive the item back?

    Yes its a bit like ebay but without the bidding and its moderated and they have told me i must give a refund before i recieve the ipod back

    I recieved a email from the moderator saying

    • Your details will be posted on the bad traders forum
    • I will supply your home address to the police
    • I will also advise the buyer to commence small claims proceedings at the same time. Please note a CCJ should be taken seriously
    The person paid by Bank Transfer

    Yes i would be willing to refund the item when i recieve the ipod back so i can examine it

    This has scam written all over it.

    The police would do nothing as it is a civil matter - so ignore any threats about that. Small claims you would be able to defend and settle before any further consequences. Stand your ground, they are being very unreasonable. Also, make sure it is your Ipod you get back, if it's a fake / broken / other then refuse to refund.

    I dont like the fact the will use my name and maybe address in the bad traders forum are they allowed to do that put my details on a forum?

    Its not like i didnt send him the ipod i did
  • It's probably somewhere in the T&Cs about they can share information but send an email explicitly prohibiting it if they did not. Copy yourself in so you have proof it was sent and a read receipt to prove that they did read it.

    My advice would be to steer well clear and to ignore any more threats. Tell them you will be more than happy to refund once the item is back and you can confirm that it was the one that they sent. Otherwise tell them where to go.

    Also, name & shame - this bunch of bullies sounds like it could do with teaching a bit of a lesson!

  • Guess i will steer clear i have offered a refund in the forum once i get the ipod back if thats not good enough im just going to forget about it

    They will not publish your real name and address on an open forum... just your username.
    They will, I understand, pass your real name and address to the buyer... but he already has those, doesn't he?

    The buyer is saying there is an engraving on the back saying "Happy 22nd Birthday Matt Love Bianca". I would be somewhat upset to see that too!

    Just as an aside did you mention this engraving?
