Thanks - do you think I have a case? My confidence is at an ultimate low now and i am struggling to get through day by day.
I am planning to get to work on my grievance next week I have about 3 box files worth of evidence on old horrible boss and current one.
Since I had that text today it has completely thrown me over the edge.0 -
I agree with you that telling them is a waste of time. Especially because of the old adage, if it ain't written down it didn't happen.
Procedures are generally harder to ignore if they are documented.
So, first make sure that you save both the voicemail and the text.
Type out a complete transcript of each of them.
Title them appropriately e.g. Voicemail received from ? at (time) on (date).
Then a cover letter titled, Notice of formal Grievance.
On Tuesday 4th May 2010 I sent a voicemail to ? informing him/her that my GP had signed me off sick.
On Wednesday 5th May I recieved a voicemail from ?. Please find transcript enclosed.
Also, on Wednesday 5th May I received a text from ?. Please find transcript enclosed.
It appears that I am being summarily replaced and I would like a written explanation of this at your very earliest convenience.
Sign and send a copy, by recorded delivery, to your manager, area manager, regional director, head office HR department and any other relevant recipient.0 -
H, I can't add anything except to offer support and tell you to think only of yourself and your baby - that is the most important thing. I think you have done well to keep evidence of all that has gone on and that you really need to push your union into backing you up as regards a grievance & complaint against the managers/company for all that has gone on.
And as far as I know, they can only force you into early maternity leave if your illness is pregnancy related - which it is not, it is work related stress. Please have a good read up on your pregnancy and work rights online, they cannot treat you unfairly because you are pregnant which is what it sounds like to me.
I have had to do the same myself lately because am currently 20 weeks pregnant, working in a branch and been under a lot of stress - although I have not had to go through as much as yourself. I read all I could online about pregnancy and working rights and got the union involved who were great.
I think you have a very good case against this company & your managers.
Please remember if you return to work, they cannot force you to take on a lesser role or a pay cut. They have to keep your job open for you and on the same terms and conditions and if they do not, you could pursue a sex discrimination claim.

I think you should post your grievance while you are on sick leave. The grievance should be about your current boss and you shouldn't mention the old one as this may show a pattern where they can imply that your are the one with the problem.NickiMcJock wrote: »Jdx

Bullot point the grievance and keep it relevant to your sitiation with your new manager.
Since I had that text today it has completely thrown me over the edge.

I have got everything at home, brought it all home about 6 weeks ago in anticipation of going on maternity leave.
As for boss - no one else has complained about him I believe. But he doesnt give anyone else hassle.
I have just found out, just this minute that my boss is moving to another job role in the company. Out with the branch network. A colleague just text me. My colleagues have been texting me since I went off sick, but to be honest I havent spoken/Txt them back as I dont want to compromise them.0 -
A good time to put in your Grievance then.
Putting them on the defensive for once might lead to a change in your future dealings with them.
Remember your grievance is against the Company as the Company is liable for the actions of it's manager's.0 -
I feel so guilty for being off my GP has signed me off for 2 weeks to be reviewed. She wanted to sign me off for 7 weeks to start with, but that would take me up to my maternity leave.0

Keep following it through with your company procedures first as ACAS have advised.
It all sounds like constructive dismissal to me, if it ends up with you losing your job at the end of all this.
It is good that you have kept all of the evidence and you should have a very strong case against your employer.
Keep in touch with ACAS, they will support you.0 -
You have absolutely nothing to feel guilty about. You just look after yourself and your litte'un. If your GP still feels after the next couple of weeks that you should be signed off until your mat leave starts you should consider taking her advice.
While you are in this 'protected period' your employer would be advised to tread carefully in their dealings with you in order to avoid a sex discrimination claim.0 -
