They could wait a year before charging, it doesn't matter. The airtime agreement clearly states that customers will be notified of any changes to the tariff 30 days before it is applied (although VF have been saying 14 since this fiasco started).
If they text you or email you to tell you they are going to charge you for exceeding the 500MB limit then you have the grounds to cancel on the basis you were missold the contract, as "unlimited" data was not "unlimited" at all it has a hard cap of 500MB. You could also reference the ASA ruling I mentioned before.
If they charge you £5 then for most people that equates to 10% or greater of your monthly spend and therefore you are entitled to cancel because the data charges are financially disadvantageous.
That's how I see it anyway.
P.s. If I cancel my airtime agreement (by any means, on any grounds) I do not intend to return my handset. If they tell me I have to, I'll just say no.0 -

T Mobile is a bit of a funny one, as nobody knows what they do, including their CS reps.
I have the Desire on T-Mobile and I cannot get a straight answer from them. If you get it from T-Mobile direct as a new customer it is 3GB internet allowance as standard with all packages and you get to choose another flexible booster. I however didn't get it as a new customer from T-Mobile and am told repeatedly I am 1GB (still enough really) using the internet booster, but would have to pay and additional £5 for extra boosters which is a pain. Might fight this later if I have the will!0 -

I did notice the 1GB allowance in the T&Cs but in the store and on their site I saw the mention of 3GB... I guess the best thing you could do is find your contract and see which one you signed... I'm sure the website stated the 3GB contract was for all HTC phones, but maybe they introduced that after you bought yours... I suspect if you ask them to change you to 3GB they probably won't complain too much...
Seriously though, even 1gb is pretty reasonable if they don't charge you for going over and just stop your streaming and p2p... I'd be happy signing a contract like that on the basis of agreeing people shouldn't be using p2p on a mobile any way... 500mb from VF on the other hand is ****ing disguisting! lol0 -

We haven't changed the terms and conditions, all we've done is announced how much we will charge customers if they exceed the FUP over several months and they continue to exceed the FUP after we've contacted them to offer them an alternative price plan but choose to stay on the existing price plan.
You are still not being charged for exceeding the FUP and won't unless we contact you to inform you otherwise. As we haven't introduced any new charges you are not eligible to cancel.

I have replied asking them to answer my original question and to confirm what the EXISTING charging structure is for out-of-bundle data usage. When they come back with a response to that I will try again.

It would be good to be able to even get a reliable service from them to let you know what your data usage is.
With 3, all you do is log into their Planet 3 service, and your most up to date usage is there - for all products. (voice, sms/mms/data)0 -

My contract is a bit dubious as I didn't get it from T-Mobile but the Carphone Warehouse. It mentions minutes, texts and unlimited internet, but not the 1GB cap, and also states that I can contact the network to set up additional bundles. I'd view this that the unlimited internet is part of the contract and I can choose another booster say unlimited landlines. When I contacted them to port my number they weren't committal on it, but said with a smart phone don't remove the unlimited internet booster. I don't think they know exactly! Still happy enough with 1GB if I want to challenge them I'll look at their site and question it.0
