Am still following this up through a number of channels. I sent this off this morning:

How can you say that I have not been notified of this change? Vodafone have made an official statement on a public forum that they are introducing new charges and the process in which these charges would be implemented. Reading this Official Statement, I was notified that Vodafone are increasing my charges and the increase in charges would increase my bill, based on my previous month's usage, by more than 10%. In fact, based on my bill dated 14th May 2010, these new charges would have lead to an increase in my bill of more than 47%!

I have written to you providing formal notice for the termination of my account with Vodafone without incurring termination fees in advance of the increase taking effect and yet you still say that I am not entitled to terminate?

and just received this in response::
we have not given you notice of a change in charging, we have said we are monitoring the usage and in the future we may charge you for going over the allowance. Until we have confirmed we are starting to charge you, you are unable to cancel your contract under clause 11 c.

If you wish to cancel your agreement you will be charged an early termination fee equivalent to the line rental until the end of your contract

I am still not sure how the official statement posted on the eForum by Tom_Vodafone does not constitute notification of a change in charges?

Email the back the part bit where Tom admits the £5 per 500mb charge is new, and then quote them the part of the T&Cs that state you must cancel before the charges are introduced...

I think their argument is that it should be after they've notified you, but before it comes into effect.

Which is grand, cos according to them, that gives you less than 14 days to get it sorted. It also implies that the eForum team cannot represent Vodafone in any official capacity whatsoever.

    Again ... well done Vodafone.

Hmm, I read that as them saying that you had to wait for the automated text from Vodafone (that starts on the 1st June) that states you've gone over 500mb... but by then the change is already in place and it's apparently too late to cancel...

No idea... They haven't said anything in a clear or honest fashion in 1500 posts...

I have just sent the following in response:

It has been stated by Tom_Vodafone on the forum that this £5 per additional 500MB is a new charge. He has also stated the process in which this will be charged to my account. I have spoken with Tom (on Friday 14th May) and Jakub (on Monday 10th May) on the telephone and they have both admitted that I will be one of "3%" of users who will be affected by this. I have also had it confirmed earlier in this email conversation that new charges are being introduced. Putting all this information together it is not possible to state that I have not been notified of the change in charges.

I am following statement 11.2.c in the Terms and Conditions, which state:

"11.2. You may end this Agreement by writing to us if:
    (a) ...
    (b) ...
    (c) we increase your Charges in the UK which have the effect of increasing your total call and usage charges (based upon your usage in the previous month) by more than 10% and you write to us before the increase takes effect; or"

You will note that I if these new charges have the effect of increasing my charges by more than 10% based upon my last month's usage, I have to write to you terminate my agreement. Based on my last months bill (dated 14th May), these new charges would increase my bill by more than 47%. I am following the letter of the Terms and Conditions we both (Vodafone and myself) agreed to at the time we signed my contract last year with my request to terminate our agreement without incurring a termination fee.

Noting all the above, I again call in to question your belief that I have not been notified of these changes.

Good work... It might have been worth iterating the point that it says you have to cancel before the charges are introduced...

Andy - are you looking to retain your handset? There are some murmurings that the wording of the contract suggests the handset belongs to the customer. However, I doubt Vodafone are likely to just hand out £300 smartphones for nothing.

Alternatively, are you just looking to get out of your contract without paying any cancellation fees, or indeed the remainder of the agreement?

I think its funny when they come back and say yes ok you can cancel but you must pay your termination fee... like they are doing you a favour

I mean since when can they actually stop you from cancelling as long as you pay the cancellation fee?

They can't... The cancellation fee is money for old rope... A complete rip off... Just gotta hope that Ofcom supports us when the **** hits the fan...

I cant see a text arriving today, or tomorrow or any other day... they will try to hide this and probably try to make it go away...

Then charge us in a few months when it has all died down thinking they will get away with it. Just quoting "its already in your T&C"
