Just received a message from the Vodafone Billing Centre.......

Just my bill though, still its nice to know they have my contact details in view of the silence over this issue.

I've read most of the 70 page thread on the Vodafone eForum and all the posts at Bitterwallet. I've just waded through 30 odd pages here, and I am still not sure what to do.

Vodafone have behaved poorly. Accurate information seems never to be cascaded down to their public-facing representatives fast enough, so the web relations teams are forever dishing out different guidance and advice compared to the advisors on the IM chat client or the 191 Customer Service team.

I think the question Vodafone customers need to ask is.. Will it be better elsewhere? To CaptainD who cancelled and went to T-Mobile.. Good luck fella! You now have to pay to collect your voicemail. T-Mobile introduced a change to all their pay monthly contracts by stealth (similar to this data issue with Vodafone).

I'm undecided. I think what Vodafone have done is an exemplary demonstration of weapons grade douchebaggery (kudos to Bitterwallet for that term) but I can't decide if leaving them would just be an exercise in cutting off my nose to spite my ugly face :p

Cancel, port your number over to a payg sim on another network and then go back to vodafone then in that case, but at least you'll know what you are agreeing to.... till the next change.

Interesting comments from DaveN_Vodafone on the eforum:

    - How can we change the prices for roaming when we want to?

The charges themselves are not part of the terms and conditions of the contract, and as such are subject to change. Whilst we are therefore not restricted from amending the charging structure, we aim to keep such changes to a minimum to avoid affecting our customers adversely where possible.

    - Can I cancel the contract because of this rise in the costs?

No. You will not be not able to cancel your account as a result of the imminent pricing change for data roaming. Data roaming is an additional service, outside of the core UK services we offer. We are providing the required 30 days notice to inform our customers of the changes.

    ---

So why dont they have to give 30 days notice when notifying customers of the changes to the unFUP.

and another great post which i think applies to the FUP and Roaming charges:

Superdave correctly states that a pricing does form part of our Agreement, therefore changing prices (Section 7 of our Agreement) is a variation in Agreement – if we as the consumer do not agree to this change, we are legally within our rights under English Law to cancel our Agreement without penalty under Section 11(3)(d) - which you had no choice but to include in our Terms & Conditions.

This is overseen by English Law, The Unfair Terms in Consumer Contracts Regulations 1999 Schedule 2 Clause 1(L): “providing for the price of goods to be determined at the time of delivery or allowing a seller of goods or supplier of services to increase their price without in both cases giving the consumer the corresponding right to cancel the contract if the final price is too high in relation to the price agreed when the contract was concluded”.

Your Contract Terms & Conditions will have no legal standing in Law and will be rendered null and void, as it is a criminal offence to have detrimental terms written into Agreements ie that you as the Supplier can change the price of services provided as you see fit to do so, and rip us, as the Consumer off. If this situation reached a point where it was heard in Court, only English Law would be taken into consideration.

Well I sent them a letter stating I was unwilling to accept their new T&Cs and prices... Wouldn't that count as a dispute?

Regardless of if you have a dispute or not you, you still have to pay for the service until the dispute is resolved one way or another. Cancelling the DD and not paying puts you at default, and you'd be liable for termination payments.

By all means write with in your complaint and saying these payments are under dispute but DO NOT cancel the DD. Doing so will trigger actions at vodafone, they'll send you a new DD form, and try and get in touch, and finally they'll pass it to debt collectors.

If you win your despute you can claim the payments back, but it's not worth the potential issues with missed payments on your credit record just to hold onto a few quid for a little longer.

You may also have to pay more if you pay by any other means than DD.

    Cheers mate,

Maybe I should have waited then, I just figured they'd carry on with their dirty games until you hit them where it hurts though...

As I've already cancelled the DD they'll have to send me a new form regardless now... But I also sent them a cheque in full and final settlement and ensured it covered me for the 30 days notice I'm meant to give them... (Not sure if I even had to give it as I think they've breached the contract)...

Any one want to take a guess at what VFs next play will be? I'll try and prepare for all scenarios....

Are there reports yet of any Vodafone users receiving a text message regarding the change to the unFUP? I would be interested to hear what a laywer or solicitor specialising in tort has to say on this whole issue of whether or not people can cancel their contracts without a termination fee.

Just had a post deleted which stated that I felt the Vodafone staff were lying to customers. Apparently that's not related to what's going on, can anyone explain how that's not related?

Cross posting from now on anyway....

Having posts deleted from the eForum, apparently the fact they're lying to customers isn't related to the thread....
