That is the argument, yes - but like Ninjagranny says and the VF rep on my chat transcript said, it won't be easy to do.

But amending a paragraph in T&Cs surely is more than a "clarification"...

    Hello!

I've been writing about this on my blog - www gadgetmosster com . A reader got in touch who managed to get 281 Vodafone contracts cancelled with the Section 11.d. Clause they have in their Terms and Conditions! This one :-

'You may end this agreement by writing to us if:

    (d) we change this Agreement to your significant disadvantage including the change or withdrawal of Services (we will tell you if this is the case) and you write to us within one month of us telling you about the change. This does not apply where the change relates to Services which can be cancelled without termination of this Agreement.’

Obviously this doesn't constitute legal advice but hopefully will help someone!

any idea of the sort of letter he sent??
    that would be helpful.. thanks

and by the way, i took a contract for N900 2 months ago, and my previous data usage was 760mb.. I wrote a letter yesterday but did not post it yet,. Just waiting to get some more data..

i mentioned clause (d) in the letter but did not emphasize on it.
    lets keep it going..

    otherwise letter
    then court

this is a joke seriously. they reserve the right to change the contract? what if tomorrow they come and say fair usage limit is 10MB?

I emailed the UK CEO, he was rather helpful last time I had issues... I politely and clearly presented the arguments about the various notices and T&Cs and have asked him to either put a buffer in place so that "straying" a bit (unitentionally) is not penalised or release me from my contract with no penalties :p

Don't know if anybody has tried already but if you Google "Free Legal Advice" 100s of sites come up. Might be worth e-mailing a few.

I know it's a long shot too, but I am going to hopefully speak to T-Mobile, who my partner is with, and see if they have any recommendations - if I say I would join them if they would help me get out of my contract with VF then they might have some inside knowledge (or tricks!) - maybe not though, but it's worth asking - shy bairns get nowt.
