This is why it's a bit confusing. I wished i had asked that specifically when talking with Lee on the telephone today - it does say that you need to write to them before the charge happens - so how does that work exactly?

Just had a new thread deleted from the eForum, as apparently it was in breach of their T&Cs

"You may not use the Vodafone eForum:
    - for any purpose other than to seek help and guidance; or provide help and support to others;"

Well all I did was query the accuracy of their statement that: "The premium tier of our new price plans includes 1GB of data instead of 500MB. If your current price plan has “YP” at the beginning of its code (see the first page of your bill) then you’re on the older version of the premium plans and are eligible to move to the new ones. You’ll pay the same as you currently are per month for the same allocation of minutes and texts, but with twice the data allowance. The handsets this applies to are: HTC Touch Pro 2, HTC Desire, Google Nexus One (which was previously 1GB), HTC HD2, Sony Ericsson Xperia X10, Samsung Galaxy S or Nokia N900." as I have the "right" handset and the "right" price plan and yet was told categorically that in order to move me to 1GB data I'd have to lose all of my unlimited (3000) minutes to landlines.

Tragically yes i can believe it.

I'm really very surprised that when speaking to Vodafone wanting clarification on the issue of charging that they are telling me something which is different from what they announce publicly (which has been modified several times) - although publicly is too strong a word - the bowels of the eForum is hardly announcing it too.

The announcements make it quite clear that charging will happen. Why on earth would they put up a statement saying this is when you ask them to expand on it they say "oh actually we probably won't charge you, but if we do then you can cancel without penalty". The T&Cs state that you have to write to them before the increase applies, but when i am billed i pay in advance for line rental/ my standard tariff and in arrears for out of bundle charges which is what any mobile internet fees would be as i understand it.

How can i write to Vodafone before an increase applies when my 'excess' use will be billed in arrears? If it's simply a case of "before the bill is due to be paid" then do i have to pay the charge?

Surely any increase in charges needs to be formally told to me, then i write to say that based on my previous use (not sure of this relevance here), but with things billed in arrears how does that work?

I'd be tempted to ask on the eForum itself but i suspect it will get locked and/or deleted

I've just replied to the email saying they had deleted my thread from the eForum and told them that I had posted the same question on MSE, could they please give an answer there instead :p

I've asked this morning in my reply to the latest email about the terms and conditons and cancelling. Mainly about what constitues notification of charges, and how i can write to them in advance of them applying when my out of bundle charges are in arrears. I'm asking simpy to clear it up and get an explanation as i can only assume that there is one.

Thanks for those emails, i have just utilised them to cc a reply to "webform" :

You are supplying incorrect information and misleading customers just like your colleagues in all the previous replies. I would like the information I have been given by you and everyone else who has replied to me in relation to this ref: #xxxx investigated and my complaint and request for cancellation escalated.

I do not care that English is not your first language, I want to be given correct information and given that your English speaking staff on the eforum cannot offer the correct information I believe this problem lies deeper than problems with the language.

    Examples of incorrect information:

Further, I've checked your data usage for the previous month and see that you've accessed only 237 MB of data. - That isn't the previous month, that is for April, We are now in June, May was the previous month, this usage is available online, so you are either stupid or deliberately misleading me.

As you never exceeded the data usage more than 500 MB, hence you won't be able to cancel your contract as clause clearly state that considering previous month usage we increase your charges in the UK. As mentioned above you are looking at my usage for April, my usage for May and June shows that I have exceeded the 500mb limit (indeed I have received text messages from Vodafone confirming this) so according to the advice you have given I am free to cancel am I not.

That was in reply to this

I've called you at 10:22 today and left a message on your voicemail. ( i have repeatedly told them not to contact me by phone...):

Thanks for getting back to me with your concern.

As per terms and condition 11b point number (3)
we increase your charges in the UK which have the effect of increasing your total charges (based on your usage in the previous month) by more than 10% and you write to us before the increase applies.

Further, I've checked your data usage for the previous month and see that you've accessed only 237 MB of data.

As you never exceeded the data usage more than 500 MB, hence you won't be able to cancel your contract as clause clearly state that considering previous month usage we increase your charges in the UK.

    Trust the above information helps.

    Kind regards,

Chris, seems like a perfectly simple and reasonable question to me, however I'm pretty sure VF are going to find it difficult to give you a straight answer...
