girders wrote:Doubt a court would consider the R&R policy as part of the contract. To be fair, look at it the other way, if Tesco had some relativly obscure (but perfectly legal) policy that operated against customers we'd be screaming the place down that they couldn't possibly claim that was part of the contract because it was only displayed on a smallnotice at CS desk...
Didn't try for this R & R myself - too much hassle and not hugely interested, but I do reckon we may now see the policy quietly 'disappeared" if they get a lot of hassle. Personally I'd like people to take the same stance that most of us do when major misprices turn up on online stores, if you get lucky then brilliant, but if you don't and they don't honour it, don't go screaming about it...
I have no qualms about taking advantage of Tesco's R&R & Boots glitches. As I posted the other day - I actually think that Forums buzzing with their brand names & everyone shopping there in hope of 'striking gold' is actually a marketing coup for them - you can't buy that type of publicity.
However, taking them to court (or the threat of) & informing consumer watchdog programmes takes it into another league - & not one they'd welcome, I'm sure. I agree, it could very easily kill off the goose that laid the golden egg - I think the outcome would simply be the disappearance of R&R. So who loses out? - we do!
Girder's sentiments are right - we shouldn't get to greedy. You can't 'win' every time & we should keep this in perspective and accept that.
If we 'lay low' - there will be plenty more R&R's in the future. Too much shouting from the roof-tops about court action and consumer watchdog programmes & it'll be gone forever - they'll conclude it's just not worth the hassle - afterall, no other store offers it!0 -

I think your fcuking it up for everyone else Smart- suits.
Thank me if u agree,
Dis me if you don't.
You are of course entitled to your opinion, but I am sure the people that are in the same posistion as me wont agree with you.
If that is the way people feel then fine, I will go away and never post here again. I will fight Tesco for my money back on my own.
Thankyou to the people that have pm'd me with support. You know who you are.
I will state once again that I unlike others (and fair play to them) did not buy an xbox purely out of speculation that I might get it for free. I wish I had that kind of money to allow me to do things like that. The reason I am fighting this so hard is because of how rude the staff at the store were to me and Tesco are clearly negating thier own policy, if a company cant honor thier own policy then there is something wrong.0 -

but she did not mark my reciept...... so do i go back tomorrow for another r & r..:DWork to live= not live to work0 -

you could just take the posters back and get a refund instead.

The question of rudeness to customers is another thing altogether and you are quite right there is no reason for anybody who serves you or works in the service industry for being rude, despite provocation sometimes
As for negating their (Tescos) own policy, yes again you are right but with all the noise you are making and intend to make then I believe the least to happen would be that Tesco may thank you for never visiting their stores again and the most that would happen would be the whole policy being rescinded
Personally I believe the various consoles should be refunded but I for one have no use for one so did not even try to get one, I mainly take advantage of the meat misprices, little and often. The greed of people on here who tried for more than one then post asking what they can do to dispose of them is simply that, greed. No need for it in my opinion
Selfishness will always spoil it for others
As for your statement about going away and never posting again, well that is your choice, every voice on here is worthwhile whether we agree with them or not
Finally it annoys me when people say "I am sure everyone will agree with me", how can you be sure? When people on TV say "everyone wants this or that to happen" I think how can you say that without asking me, still that is just my point of viewOnly time will tell if I am right or they are wrong0 -
smarts
complants, court action, watch dog etc..do u honestly think u can convince any of these bodies that u genuinley went for xbox without reading thread 1st ?
i'm not saying that u did or didn't, just asking if they will believe u or not..?
eitherway, don't not post please, the whole point of forum is for people to be able to express their own view / opinion.Back to square one, no apg, no comment.0 -
I agree everybody is entitled to their own opinion and to take whatever action they think is right. I have emailed Tesco Customer Services and will leave it at that. Was I being greedy getting an X-Box, maybe, just thought it would be a great Christmas present for the family. Anyway well done everybody who got one. I'm sure some people will be able to argue with HO more than I did.0

Jack's_Dad wrote:I thought you said earlier that you had searched for a better deal on the xbox and Tescos came out the cheapest so to my mind you got the product that you wanted for the price you wanted to pay, or would have done if you accepted their offer of refunding the difference
However, the discount didn't come off, I complained and was offered the £20 discount, I pointed out the policy and they told me it didn't apply. When the manager came he was rude to me and assumed that I only bought it to get it for free. This really upset me. If he wasn't rude to me I would have graciously accepted and gone home. But his rudeness sparked off the rest.
Are you saying that people that bought one of the current misprices should just accept a refund of the difference? For example, Ragu is on a bogof offer but the SEL states £1.07 but scans at £1.12. You are getting a better deal already than you are likely to get anywhere else, a jar of Ragu at 56p is bloody cheap! But no, people still go to CS and get thier money refunded.
Just because I am passionate about this doesn't make me a bad person. Sorry if you think my determination to get Tesco to own up to thier mistake is a bad thing.
Sorry to anyone that thinks that I might be the reason you cant get free Ragu anymore.
This might be really harsh sounding but it is the only way I can think of getting my point across. Why should I back down from this? I was genuinely overcharged, Staff were rude to me but I have to back down because I might ruin it for people that exploit the system?
Maybe the reason I did not get the refund I was entitled to was because Tesco know that people exploit the system and I have now been tarred with the same brush? Maybe you ruined it for me?
Do you see me complaining? No! If you exploit the system then fair play to you but please dont kick someone down for fighting for what they are entitled to.0 -
ben500 wrote:All this speculation will not resolve anything, basically Tesco will make a decision and fight their corner if they have to, they have something of a dillema as they will be torn between refusal and the obvious backlash that that could have and submission with just the financial question to consider, refusal could go either way with them, they could play the "We were ganged up on" approach and use forums such as these to demonstrate that, but again that would also have a negative effect in that they should have been forwarned and taken steps to avoid the situation, sympathy could go either way but is most likely to prevail towards the consumer than the company.
What you have to realise is that Joe Bloggs in the street will view those that took advantage differently to what they may consider a normal consumer, ie they may feel serves your right you tried a scam and it didn't come off, let's face it there were many with the preying mantis approach to this opportunity as spa pointed out.
I wouldn't worry either way as the next misprice has already been and gone and more will follow.
