If 2000 tried to get an Xbox360 premium then the shelf price is £640,000 at £320 each. However, the true cost is lower as Tesco do not buy it at this price and probably make 20% on the products so the cost is nearer £512k.
Also not all the claims are likely to be for the full Xbox premium and some are likely to be for Xbox Cores, the PS2 and the PSP.
I think Tesco should bite the bullit and make some positive press out of this, but then I am feeling lucky because I got a premium 360 and a full no quibble refund (even though the first manager understandably had to clear it with a more senior manager and then when the senior manager cleared it, the junior manager pointed out the price to the senior manager again but luckily they still said yes!
Are Tesco in breach of contract if they don't refund other shoppers because they promise to do so and is that promise a part of the contract?
Perhaps this may go to court?0 -
All this speculation will not resolve anything, basically Tesco will make a decision and fight their corner if they have to, they have something of a dillema as they will be torn between refusal and the obvious backlash that that could have and submission with just the financial question to consider, refusal could go either way with them, they could play the "We were ganged up on" approach and use forums such as these to demonstrate that, but again that would also have a negative effect in that they should have been forwarned and taken steps to avoid the situation, sympathy could go either way but is most likely to prevail towards the consumer than the company.
What you have to realise is that Joe Bloggs in the street will view those that took advantage differently to what they may consider a normal consumer, ie they may feel serves your right you tried a scam and it didn't come off, let's face it there were many with the preying mantis approach to this opportunity as spa pointed out.

Doubt a court would consider the R&R policy as part of the contract. To be fair, look at it the other way, if Tesco had some relativly obscure (but perfectly legal) policy that operated against customers we'd be screaming the place down that they couldn't possibly claim that was part of the contract because it was only displayed on a smallnotice at CS desk...
Didn't try for this R & R myself - too much hassle and not hugely interested, but I do reckon we may now see the policy quietly 'disappeared" if they get a lot of hassle. Personally I'd like people to take the same stance that most of us do when major misprices turn up on online stores, if you get lucky then brilliant, but if you don't and they don't honour it, don't go screaming about it...0 -

I dont see how? I genuinely bought an xbox360 because I wanted one and I bought from Tesco because the £20 off deal was about the best I could find.
I had looked at all the electrical retailers and none were as good.
When I went to pay I was overcharged so took it up with Customer services. I did know about the R&R policy but did not buy the Xbox and expect to get it free.
What I did expect from Tesco was for them to honour thier policy and refund me all of my money for the overcharge as the policy clearly states.
Why should I back down from tesco for thier mistake? They are falsly advertising a policy that when put into practice they wont honour.
I intend to take this as far as I possibly can and I would think there are plenty of people behind me.
I intend to contact the advertising standards authority regarding this and I hope that members of this site will do the same.
Now, how is the best way to go about doing this?0 -
Thankyou to whoever the original poster was regarding the Xbox 360 (who was that btw, so I can thank him/her?).
Well I went into my local Mr. T's and low and behold the Buy Xbox 306 & Game and get £10 off SEL was there.
Unfortunately, there was only a 'Core' system left.
Well I had second thoughts anyway by this time (with the label stating 306 and not 360), but decided to try for the 'Core' anyway.
Console and game went through the checkout, at full price, but I figured the discount would be on the receipt.
Wrong! No discount.
Then to top it all, after waiting for about ten minutes for the SA to bring the Xbox from the storeroom, she brought the wrong one. A flippin' premium pack. !!!!!!?
My !!!!!! was nippin' by this point.
Should I try for an R&R and risk losing a bargain premium pack?
To hell with it I thought and went to CS with just the receipt.
He told me it was only for chart games and that the R&R wouldn't be honoured.
Well, I told him there was no mention of 'Chart Game' on the label I saw.
So I followed him back to the shelf to find it did say 'Chart Game', which was handwritten.
I had to smirk at that point. That's just been written on there since I was in earlier I told him.
Anyway, the game I'd picked was in the chart.
He didn't even argue (which was good, coz I'd taken a photo of the SELl in any case).
He went off to see his superior (20 mins) and game back with:
"but the chart changed today and hasn't been updated", but we'll give you a tenner off.
Not my problem I said, I'm aware of your policy.
Hmm, I'll have to see the duty manager.
Went away again (another 20 mins) and came back with "we'll give you the game for free".
At this point I told him I'll come back tomorrow when HO is open and that he could discuss it with them.
Off he trots (another 10 mins), we'll refund ya!
So all in all a nice result!
Just hope they don't cancel the refund.
Unsurprisingly, he removed the SEL.

At the end of the form they ask you to upload a copy of the advert. I have uploaded a copy of the SEL that is on my webspace here https://www.smart-suits.com/xboxsel.jpg so download that and save it to your hard disk. Then there is a box for you to put a URL, I put in there http://www.tesco.com/customerservices/custServCustomerDesk.htm there is the refund policy as clear as day.
I suggest that others do the same. I am off to look at the BBC website now to see if I can send the same to Watchdog and I will be looking at a local consumer programme the ferret.0 -

As a regular R'n'Rer myself I have been reading all the posts here for a few days with interest and came in a bit too late for the start of the Games Console farce. I probably would have tried it myself if it was available to me locally, but it seems that with all the different offers/sel's around that Tesco have tied themselves up in knots and are, now (with their backs to the wall) deciding to go down the clear cut decision to not refund at all on this issue. I think we should just pat everyone on the back who managed to claim a free console, move on and just look out for the next big error to come along, because you can guarantee that it will especially now that Xmas is around the corner and more stock will be in stores.DTD - Doing Tesco Daily - while I still have vouchers!0
