Do Tesco always refuse to sell broccoli without the stalk on?!

Was in Tesco the other day and the chap was scanning my stuff and it came to the broccoli and he said 'sorry I can't sell you the broccoli as it hasn't got any stalk on', I said 'what?' and he repeated 'we are not allowed to sell broccoli without the stalk on as I normally work on 'fresh' and we make most of our money on the stalk, so you can't have this one, but I can get you another one. I said OK that's fine, but what are you going to do with that piece of broccoli? He said it would be thrown away as 'waste'. I said 'don't be so ridiculous, that piece of broccoli was on the shelf with the rest and if you didn't want to sell it then it shouldn't have been on the shelf, so actually you do have to sell it to me. (I was now very insistent and a bit stroppy as I could not believe that they were going to throw it away) He obviously had to check with his manager and came back and said that on this occasion I could have the broccoli but in the future I would have to only buy the broccoli with the stalk on. Do all supermarkets do this or is it just Tesco? OUTRAGEOUS! The next thing they will be doing is selling apples with the tree branches on! (as they already seem to do it with the vine tomatoes)

You can't demand they sell it, but afaik, that's not a common way of selling broccoliSquirrel! If I tell you who I work for, I'm not allowed to help you. If I don't say, then I can help you with questions and fixing products. Regardless, there's still no secret EU law.

Well I didn' demand that they sell it but if it's on the shelf and therefore offered for sale, surely I have some sort of right to buy it and I only got a bit stroppy when he said they were going to throw it away, which in this day and age is an OUTRAGEOUS waste of money!0

Agreed.
But legally they can refuse service to you for any reason. And I believe technically, nothing on their shelves is 'offered for sale''; rather you 'offer to buy' by taking it to the checkout, at which point they either accept or refuse.
But all that is beside the point - it's a bit of a stupid policy, but I don't think it's the same in every Tesco store.Squirrel! If I tell you who I work for, I'm not allowed to help you. If the OP had broken the stalk off I can understand the attitude but he said it was like that so why the problem? I use the stalk it is very nice actually...as long as it's fresh.0

LOL next time you need some give me a shout, I have 2 boys who don't like the trees and will only eat the stalks, and we can split them! Stupid policy, but it's maybe to stop people snapping the stalks off so they don't need to pay for the bits they don't eat! It's what is inside your head that matters in life - not what's outside your windowEvery worthwhile accomplishment, big or little, has its stages of drudgery and triumph; a beginning, a struggle and a victory. - Ghandi0

You don't have a "right" to buy anything in a store. None of us do. But having said that...and I only got a bit stroppy when he said they were going to throw it away, which in this day and age is an OUTRAGEOUS waste of money!
... what they are saying here is the daftest thing I've heard in a while. I would say "it's the daftest thing I'll hear all month" but with the election heaving into sight and all.
Anyway... I'd have said if you liked the look of it and they were only going to throw it away anyway then this is pure profit for them. Unless they have good reason to think you damaged it yourself they should be grateful that you're taking it off their hands. If you don't stand for something, you'll fall for anything0 -
Checkout operator sounds like a right jobsworth. I used to work in the produce department at the time when many items were weighed, you would see old people taking the leaves off white cabbages so they didnt need to pay for the full thing0

I worked in a fruit and veg shop years ago and we used to get students coming in all the time and breaking off the majority of the stalk so it was cheaper, did drive us a bit mad as the broccoli was priced as to include the stalk and if it was sold without then would have been priced at a higher rate, try telling them that tho!!! lol I can see why they might have this policy in place...0

That is disgusting, they will be selling spuds with no mud on them next. Get down to trading standards pal and get the police down there and let us round up these numpties and throw them in the slammer for a couple of days.
While they are there, we the proletariat will be able to rampage through the place and take our reparations.0
