Hi All
Letter sent to Moorcroft outlining my financial situation and informing them that I am DMP and that CCCS are authorised to deal with my financial affairs and therefore they need to be dealing with CCCS directly failure to do so contravenes the Lending Code and OFT Debt Collection Guidance.
Also enclosed £1 and requested copy of original credit agreement and a statement detailing payments to date.
Highlighted that I am in dispute with creditor regarding the outstanding balance.
Pointed out that I had received letter from creditor a week ago agreeing to a further 3 month payment plan.
I have also included the template for door step visits advising them not to visit my property as they will be breaking the law and that if they wish to visit then they need to make an appointment I have no intention of making such an appointment.
I have informed them that I will continue to pay to them what I paid to the creditor via my DMP.
I have asked them to respond in 12 working days in accordance with the CCA.
Now its wait and see. I have laid my cards on the table lets see what comes back.
Prof P F & F is up my sleeve waiting for the next hand to be dealt.
Well done Mikon, have to say I am tempted to go down the dark side when Barclaycard buy out Egg as there is no way they'll get any original CAs. PPLBM Jan 2010. DFD 2016. :think:

Have you noticed how everybodys resolve has strengthened from the original debt laden, miserable, know nothings who have gathered on this thread over the last year?
The odd thing is that we all just want to pay back our dues but the banks/card co/DCA's etc etc are all putting obstacles in our way?
They constantly bully and harrass because they do not realise that most people are generally good, and found themselves in a situation, that, suddenly, was out of control. They treat us as if we are all going to do a runner!
So, we (the people) decide that if you want to play difficult then we can play difficult and it's going to cost the creditors MORE money in the long term by replying to CCA's, or taking us to court, or dealing with the ombudsman or dealing with official complaints.
If they just left us alone to pay, we would all be happy and the debts would, eventually, be cleared.

Hope everyones weekend has been ok - I have set my self as many No spend days as i can from when i got paid on Thurs, so far nothing spent Fri or Yesterday - and i must stick to it this month so i can finally get my car fixed!

Ok Mikon
No one is going to take you to court for £200, it costs around £500 to take some one successfully to court, so not worth it and you are paying it off through a DMP, so not even viable.
Moorcroft are famed for spewing out computerised letters at a rate of knots, this is just another of theirs to scare you. and it worked!!!!
It is very unlikely that Next have a viable CCA but that doesn't really matter unless you stop paying, they'll just ignore it as long as you keep paying, if you stop paying (if its UE), they'll chase you for a year, try to get you to sign numerous new agreements and generally be pains in the bum. You would then ignore them for a further 5 years and the default and the money would drop off your file, that is how checking to see if a CCA is UE works. The OFT and the FO don't give a fig if they have CCAs or not, it only really matters if they have made enough mistakes to prove to a court that it isn't a properly prescribed agreement. and no one in their right mind would take a creditor to court to prove anything, the rule is let sleeping dogs lie.
They are breaking a few rules by not dealing with CCCS, report them to the FO and the OFT, Trading Standards might even listen.
Oh and they are in default of your CCA request if the don't reply within 12+2, which they won't, but again it doesn't really matter if you are still paying, it doesn't get you anywhere.

Oh and I agree wholeheartedly with PPP, offer £40 as a f&f and get rid if they are causing you worry, they are just muppets, and inefficient muppets at that.More than Two Years in

A beautifully described precise of how UE works, I frequently lurk over on the dark side website, it is a mine of information and thoroughly recommended, even if you have no intention of going UE. PPLBM Jan 2010. DFD 2016. :think:

How is eveyones Tuesday but sort of Monday going? - I have to say i'm going to winge sorryJust feel a bit down about the whole situation checked my CCCS statement which made feel sick, and the whole Barclaycard issue is bothering me. I really need to give CCCS another call and see what can be done.
Also Seeing PDD back :wave:makes me wonder about looking into the darkside with BC as my agreement as far as i can tell from my credit agreement is April 2007 is this the cusp of UE?
sorry guys will perk up tm just feeling like there is no end in sight atm, especially with a wedding supposldey being booked.Family are helping but it makes me feel poop knowing the debt i have with nothing to show for could have been saved and payed for wonderful things urgh

It looks like Next are going ahead with the DCA so maybe I'll be around here sobbing if I get the Moorcraft letters like Mikon:(
Halifax are still charging shocking interest. I really need to do something about that. Bcard are adding interest too, but the balance is small and the interest is about £2 a month.
I have my next review in July and by then will have £130 more coming in per month, not including any up/down of tax credits. I will have to adjust my SOA as cost of living has increased, but I should still be able to increase my monthly DMP payment. My concerns are getting too close to min payments and having interest piled on again. If I could keep the £130 to save for F&Fs, that would be a better plan:T

The stage we are at is as follows:
We owe approx 80k between 9 preditors, and pay a sizeable sum a month into our dmp, tough going but managing to keep our heads above water.
Lloyds Loan - sent us letter confirming repayment plan til june then want an updated income/expend, only get annual statement so not sure about interest/charges :cool:
Next - keep sending us new credit agreements, statment continues to show service charge - we have simply filed these :cool:
HSBC Master card - accepted repayments - to be reviewed in sept, reduced interest to 16.9%
HSBC overdraft - metropolitan collection accepted reduced payment subject to periodic review
Alliance Lester overdraft - applied suspension of recovery action whilst dmp in place :T
NRAM loan - letter accepting reduced payments for 12 months
Mint Card - lots of messing around with debt collectors now managed to get back on track with cccs paying them direct, interest/charges have stopped appearing on statements, but no letter of explanation??
Mint Loan - contacted cccs stating they do not accept reduced payments :mad::mad::mad::mad:
Barclaycard (everyones favourite) - because the money we/cccs pay them meets their minimum monthly they will not stop the interest/charges, :mad: :mad::mad::mad: but will reduce interest to 14.9%:cool:
Any advice/letter templates to try and reduce interest/charges some more would be of great help. I think Mephisa - was it you who said to keep sending them letters to do this, if we dont do it no one-else will? and if you dont ask you dont get???
5 payments down, many more to go...any advice gratefully received.

PS - we bought a second hand renault scenic - ace for camping - had to fix sun roof as it got stuck but through the wonders of the internet and forums we found out how to wind up back manually and is now working fine. What would we all do with out the web???
