Hi all - sorry for not posting sooner got broadband fixed after christmas then laptop gave up have managed to get it fixed FOC (know someone who is good with pc's) Nothing to report on DMP getting worried tho as year anniversary is beg of march so expecting to hear from creditors who agreed to plan for a year. Although Northern Rock only agreed to six months and I havent heard from them apart from a statement. I'm just expecting the worse. BCard and halifax still charging interest trying to save to purchase a printer so I can write to them but its not a necessity so not sure when I will be able to afford one. Money seems to go on food and petrol these days.

Hi Gabriella, thanks for getting back re your review and great news re 2020! Hope you managed to keep some for f & Fs.... Do you still have to send pay slips etc when you have a review?

Hi Tedsd, No no payslips to send in which i thought was odd as i have gone from being un-employed to employed but it works better for me that way :D:D:D:D

As Gabriella has stated no payslips are required just a verbal confirmation. That is all CCCS required from me when I undertook my review.

    Hi everyone

    Here is some advice

    1. Do not sign anything any new credit agreements.

    2. Do not sign any letters you send to creditors.

    3. Write to your creditors asking them to contact you in writing not by phone also ask them to remove all telephone numbers from their records.

    4. If a creditors uses threatening language such as we will ring you at work remind them that it is offence under Section 40 of the Administration of Justice Act 1970 and Section 1 of the Malicious Communications Act 1988
·to harass of debtors with a view to obtaining payment including the issue of letters which convey a threat or false information with intent to cause distress or anxiety.

    5. Enusre that erverytime you contact ypur creditors that CCCS or Payplan are authorised to deal with your finances and therefore they should speak with them and give them your refrencence number.

    6. If you get letters from creditors that your not sure about contact CCCS or Payplan and send a standard letter stating point 5.

    7. Keep a diary of all contact with creditors and ensure you also make a note of when your reviews with each creditor is due.

    8. Please note that some creditors will notify you of acceptance and others will not.

    9. Please be sure to check your monthly statements and by law your entitled to one per year.

    10. Watch because some creditors such as Barclaycard will stop interest and charges for the first 6 months and for some reason will then restart interest at a low level.

    11. Remember all the letters you get from creditors always use the word may We may take you to court, we may pass the debt on to a third party, you may incur charges etc. Remember the majority of letters you receive will be computer generated.

    12. Keep all correspondence from your creditors.

    13. Unlucky for some but most calls stop after about 2 months and some creditors stop immediately but things do settle down.

    14. Creditor or Debt Collection Agencies threaten to dome to your house to collect debt.

    To Whom It May Concern

    Dear Sir / Madam

    Re your reference:

With reference to any possible Home Visit you may be contemplating, I would advise you that OFT rules and regulations clearly state that you can only visit me at my home if you make an appointment and I can advise you now that I have no wish to make such an appointment either now or at any time in the future. Further, there is an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc. (Armstrong v. Sheppard and Short Ltd [1959] 2 Q.B. per Lord Evershed M.R.). Therefore, take note that I revoke license under Common Law for you, or your representatives, to visit me at my property. If you send "doorstep collectors" to my home you will be reported for harassment and be liable for damages for a tort of trespass. You would also be liable for conspiring in a tort of trespass by acting in defiance of my instructions and sending someone to visit me nevertheless. Should it prove necessary, I will obtain an injunction.

    Yours Sincerely

I hope these cover some points that you all have queries about. Remember

I hope these tips help you.

I started my DMP eight months ago and if you read my last post you will see I experienced the worry, nightmares and tortured myself with what happens if this happens or that happens but eight months down the line its the best thing I have ever done. I am not ashamed of my situation I am addressing it and facing up to my debts. Together we will get each other through this.

Have a good weekend everyone I hope this post will help allay some of your fears.

Welcome to the gang. Interest stopping is random, generally settles around 3 - 6 months.

Hi welcome onboard the good ship DMP, guaranteed to give you a choppy ride!

The first thing you need to do, and I know this ain't easy, is to relax and let things settle down and take their course.

Interest may be charged by some creditors at first, some may suprise you and play ball, some will be complete *******. Thats something that you learn to deal with.

Don't try and jump into anything, don't expect anything, don't rush anything. Just sit back, start paying your monthly payments and see what happens over the next couple of months, your going to be bombarded with telephone calls and letters anyway so that will keep you occupied.

Don't stress about this however as all you need to do when the phone rings is say your on a DMP with CCCS and give them your number. That should be the end of it. If it isn't pop back on here for advice on what to do with the numptys.

Letters are computer generated junk usually with lots of "mays" and "ifs" so just file them in your newly created DMP folder (get one) for a rainy day.

Defaults will come. Santander, my personal favourites, just love sending me defaults. My personal loan has been defaulted three times I think now. They love letters do Santander.

So my advice after all this waffling is to sit back, try not to worry about what MAY happaen (it probably won't) and get used to living within your means. You may find it hard, you may suprise yourself and quite enjoy it. It's not easy but it's something you have to do.

I'm skint all the time. I just don't buy anything (sounds easy, it's not) but I make sure all my bills are covered. I make sure I leave enough for food and petrol and the occasional treat out of my HUGE entertainment budget of £20 a month.

What I gain is the knowledge I will be debt free one day, my debt is shrinking slowly and the fact I have learned a massive lesson and will never borrow another penny ever, ever again.

Oh and my wife stood by me through all this and that you cannot put a price on.

Try not to worry and make the best of it you can. After all, what alternative have you got?
