Mikon posted this some time ago so I thought i'd dig it out.
Section 9 is on Financial Difficulties, paragraph 144 is for those still being harrassed.
Quote this back to your pain in the backside.
There are other paragraphs on Debt Collection Agencies and how the creditor needs to show due dilligence when using a DCA (basically they are responsible for DCA dirty tactics).

Even more confused than ever now after speaking to CCCS - they have advised us to speak to Mercers after I explained about the 18 calls in one day? They said that it might not be harrassment but they may just need something from us... yes, money that we haven't got.
I have explained about the letters that we have sent to ask that everything be put in writing but was told that we should speak to them.
I then mentioned the debt collector that they are threatening to send round and was told that this may happen to discuss payment. When I said that I thought that they couldn't send anyone without invitation, she replied that they can send someone around to discuss payment
Anyway, OH is not going to speak to them so we will just carry on and see what happens:eek:Debt Free 1st March 2017

Just caught up on all your posts, I especially like Prof calling creditors everyday for 20 days....BRILLIANT!:D
Not much to report, BF has work now (not sure if I'd told you that already?) so thankfully don't have to reduce DMP payments, still struggling to adjust to paying rent/bills etc. but we're getting there.
I have had a letter from Metropolitan about my HSBC loan (biggest debt of £7k) which is what I was expecting. Still pretty scary though :eek: The letter isn't actually that bad, I'm going to call the CCCS today to let them know.
Not sure whether to call Metro and let them know about CCCS/DMP or let CCCS deal with it? Assuming CCCS will have time to send Dec payment direct to Metro....guess I'll find out!

Also, spoke to CCCS re Metro, they took down details and said next payment would go directly to them (FYI they're sending everyone's Dec payments out on the 21st, so they get there in time for xmas).
Then spoke to Metro who were understanding, took my CCCS ref and details and said they await the paperwork from CCCS. And won't harass by letter/phone for 4 weeks (when I'm sure they'll have received all the paperwork).Paddle No 16

Ellies, so sorry you're having such a bad time. Very odd re CCCS, I remember being told that if a creditor had anything important to say they could put it in writing which is the same as the OFT guidelines....
Hi Ted, yes I was surprised at their response too as so far they have been really helpful. I also mentioned to them that Santander had asked for a review of our finances now after several months at reduced payments but she told me to ignore that one.
I have been so down today about it all, I really don't know what to do for the best. Friday's are the only day that I can ring CCCS due to work commitments and I don't feel as though I am any further on.

Have you considered unplugging the phone for your sanity?
I was terrified about calls at the start. I don't get them now - I think I became a bit of a problem for them when I started popping the phone by the tv and just letting it cost them and waste time. The other tactic I had was to say ooohhh hello I'm so glad you've rang. What are you going to do to help me with the financial nightmare I am experiencing as a result of the exorbitant interest charges you having been taking from me? Can you take me through the steps you have gone through in your company since you received my letter? Is that the best you can do? Surely you can reduce the interest further or better still seeing as you earn so much profit and you know I'm on a DMP then stop altogether? When are you going to get back to me by? Shall I call you again in an hour to see what the progress has been? Can you borrow from one of your sister companies to help me? I .e completely turn the tables on them. Oh what fun.
Sorry Ellie, not meaning to be flippant and I can recall when I was a complete wreck and though I was going to be spending 4 years living in my bedroom with a dimlight on. Information is power to you. As PDD would say they have your money but they can't have your life. They rely on the sensitive side and go for the jugglar, well don't let em have it, you are worth so much more.
Most CCCS are very helpful but there are a few that seem to resent the DMP route and tell you youve no rights to challenge etc and one in particular is very very patronising. If I ever get her now I make an excuse and say I'll call back later.
You are not running away, you are paying your debts back. They need to recognise that and that you have basic human rights.
Lift a glass of something and see the weekend in Ellie, infact as a mark of camaraderie I think we should all have one for you. If it doesn't look better next week I'll come over and answer that darn phone for you.

RE CCCS do you get your own named person or is it potluck when you email or phone? Payplan have a named person who I email, (fingers crossed not wanting to tempt fate and all that!!!) luckily not had to use them all that much.
Am intrigued by the person coming to your door bit, as I also thought only certain people had a right to do that without a court note.Paddle No 21 :wave:0 -

I thought that, in fact i'm sure, that if a DCA says "we are coming round" and you write back and say "well actually your not because I refuse you permission to do so" then they have to abide by that instruction.
Anyway, if they did turn up just open the door and then say goodbye and close it again. End of story really.
For some reason DCA's seem to have stepped up the nastyness. Do you think its because we are approaching Christmas and they think we are more amenable to the threats?
I received a strange letter from Robinson Way today asking if I was Eyeopener or not. Odd because all my creditors know exactly who I am.
Ho hum.
