Without a paddle... support for anyone starting a DMP in 2010 (part2)

Prof - we've had two that were outright UE (one of them even sent us a letter saying they could not locate the original CCA at all), and two that have simply not responded with the CCA (however both of them sent letters saying that they were looking for it, would get back to us when they located it, and were putting our accounts on hold until further notice - and we haven't heard anything in 2 months). One was enforceable, however, we are now requesting reimbursement on the missold PPI, and since the amount we still owe is about £250 lower than the amount they will need to reimburse us on the PPI, we're hoping that will take care of that debt completely. Another that was enforceable is currently receiving small payments from us each month, and they are not hassling us at all, although they are adding interest, so we're hoping once we have sorted these other accounts that we can put together something for a F&F and get that one cleared. The last one is still wrangling about demanding a signature, however, we rather suspect they cannot find the paperwork, as they couldn't find the original paperwork last year when we called them with a question regarding the PPI. My current partner accrued a lot of debt with her ex. The debt management company they are using is charging 40 quid a month in fees - is this excessive? It is excessive and you don't need to pay at all. CCCS and Payplan will set up and run a DMP for free, the £40 will be going to pay off your debts, not line someone else's pocket. CAP and CAB can also advise. There is no need to pay for this at all.More than Two Years in

Get out of that DMP as soon as you can. Why pay, as Dopey says?
Don't delay on this, contact CCCS or Payplan today, not tomorrow, today and get that £40 paid of your debts. Its £480 a year! on a five year DMP thats £2400! See how it mounts up?

Hi everyone,
I haven't posted in a while but I have been reading most days. I am becoming increasingly curious about the CCA/UE or whatever the abbreviations are!
What makes an agreement unenforceable? Some mentioned pre 2007. Does that make it more likely?
My DMP is going OK though, and I am living well on the budget. It has been an education for sure but I would not change the last 6-8 months as I have got over my materialistic ways, it has been like therapy or retail rehab! Truth is, my £4 jeans from Primark ARE as good as the £59 Boden ones! We have had an amazing summer with a £63 National Trust membership and a picnic hamper, and there are loads more autumn events to come. Good times are worth so much more than a house full of clothes, cosmetics and overpriced junk.
BUT, back the point. Although I am responsible for running up so much credit, I do feel some my creditors acted very irresponsibly in giving me HUGE credit limits, while I had other cards/catalogues. Then they sit by and do nothing while I obviously was in trouble as I was bouncing credit card cheques between them for a few years while not working, before they finally pulled the rug a month before Christmas last year. For that reason, I am curious about whether they are all enforceable.

Welcome bak LJm23k, your a bit like me have gone and got all curious about the UE. But need to find out when the my accounts were opened i know my loan is def not pre 2007 !!!!!! as its my largest, but other 2 might be.
Lots of reading to be done i thinks, off to find PDD diary.:)0 -
