sorry am just wallowing in self pity at the moment, its all such a mess and i am not the strongest of people i am not known for standing up for myself but this time i have too!
no you're not Louise, this is a very stressful time for you and its not everybody that can deal easily with it all. I am a senior manager at work so I'm so used to dealing with eejits it came quite easy to me. I was just surprised at how incompetant and lying the creditors all were, much much worse than I anticipated, I'm amazed they ever make any money at all, cos they are useless and communication is a foreign concept to them. so like I said relax!More than Two Years in

Hi LJM
Miss Goody two Shoes indeed!!!lololol
If the debts are pree April 2007, they may be unenforceable, ie they don't have a enforceable agreement. basically the older they are, the more likely they are to be ue, some of ours were in 1990s and even 1980s.
You need to read up on UE here http://forums.all-about-debt.co.uk/viewtopic.php?f=13&t=8, Niddy gives a lot of good advice.
Good luckMore than Two Years in

I just registered on niddys forum so can't wait to read all the info. I could safely say mine are all pre 2007, the earliest would be late 1990's.
I need to figure out if I have the strength to fight this fight as, like I said the DMP is going smoothly so far.
See you on the other side PDD, I've found Profs diary and have been having a wee read.Paddle no. 12

I wonder if there is a link between stopping interest and unenforceblility? The 2 I have that are only reduced, not frozen are the youngest of my debts, the rest I think are pre 2007.
Mmmmm, maybe just a coincidence.......Paddle no. 12

Prof - only you can really decide whether or not you want to go the UE (unenforceable) route. We went that route mainly because we are doing a self managed DMP, which gives us a bit more leeway, and a fair few of our creditors were not being cooperative about accepting what we were paying and refused to stop charges and interest at all. So we rather felt that we might as well be proactive and go that route first, then after we've checked the CCAs, we move on to PPI reimbursement for those that it applies, and then we are making payment arrangements. This is (at the moment) what works best for us... but it may not be the best for everyone. I would say just read through Niddy's site, see what it's all about, and make your decision based on your own personal circumstances and what you feel comfortable with. Best of luck!
Louise - there's no point in feeling bad about the situation. I try to remind myself when I am feeling low (especially when the occasional letter comes from a creditor saying "you need to pay more than what you're paying") that I am at least dealing with the situation head on, rather than ignoring it like so many others. And I think that after a while, it does feel easier and you're less hard on yourself. And as far as standing up for yourself, it gets easier. The main thing to remember is to stay calm and don't let them shake you up.MSE mum of DS(7), and DS(4) (and 2 adult DCs as well!)DFW Long haul supporters No 210:snow_grin Christmas 2013 is coming soon!!! :xmastree:0 -
Some good work going on on the UE forum, i've just been reading a couple of diaries. Wow, it just shows you what you can do if you put your mind to it.

I don't think this is the case, I've got a card which was taken out in 2008ish, and when I sent the 1st letter they wrote back saying when we get 1st payment from CCCS we'll stop interest/charges. And even more shocking they did as promised!!
I think it's more down to pot luck than anything else.
Good to see you back TED - Hope things are going well for you x0 -
