  • Thanks Dopey, am gonna spend a bit of time talking it over with loved ones, am about 80/20 in favour at the moment. Ultimately, I think it is the way to go, just need to be sure I am ready for it. Am going to give Niddy (how good is he, when does he sleep?) all my details tonight and go from there.     prof I've replied on your thread on Niddy's site.

    If a creditor is still adding on interest and late payment charges when you are on a DMP you can complain, a lot. There are guidelines that say they shouldn't compound your hardship. I was having this problem with Amex, still adding interest and ignoring all pleas not to, one of their foreign operatives actually told me that because they are an American company they can do what they like and don't have to look to any British guidelines. the thing is folks, they lie, they cheat and they bully, if they won't stop interest/charges phone the Financial Ombusman and COMPLAIN it is very simple, just a phonecall and they then write to the company, Amex apologised, refunded all the charges and interest and took an extra £50 off the balance for my trouble and they had a complaint logged against them. Actually it is almost your duty to complain, if they think they will get away with atrocious behaviour, they will do it all the more, so get on those phones tomorrow and COMPLAIN!

    Thanks for this. I'm going to write tothe Post Office again (or do I get OH to ring as its in his name) BUT i'm a bit worried about winding them up so early on in our DMP. I realise though that I ill need to be stronger as my previous letter asking them to stop charges, explaining our position etc hasn't even been acknowledged.
    Should I mention the ombudsman in my letter? Hope this makes sense. Any advice very welcome. Thanks.

    there are a fair amount of letter templates around on MSE and the CAB website asking to stop interest. I would use one of those, my conversations were on the phone with Amex but don't phone unless you are confident you can deal, ie calm and assertive and polite and not prepared to be fobbed off. They are being unfair because you are in hardship, and that is what the FOS is for, if no one complains, these guys think they can get away with it. I wouldn't worry about what they think of you, they think you owe them money and they want it back, and now, not a minute longer, so don't worry, look after yourself and family first and don't give a fig for any creditor, their good opinion is something you can certainly do without!!! Good luck, remember, calm and assertive.

    You have to look after number 1 here, you have to be proactive. Basicall they don't give a stuff about you as an individual you are a number who hasn't paid them back. Computer is now working overtime, thats all it is. I doubt if a human being has actually looked at your case.

    Complain officially to the Post Office head office, they HAVE to take your complaint seriously they cannot ignore it. If you look on their website there should be a complaints procedure so follow that.

    If you don't get a reasonable answer then go to the Ombudsman.

    My Santander complaint resulted in the refund of some charges (still not got them yet but I will) and the stopping of all further interest and charges. So it does work,as it has done for Pure Dead Dopey.

    They are winding you up by not reducing the interest, I would mention the Ombudsman, Mikon on here had an absolute nightmare with Citi and the Ombudsman certainly helped him. Remember, a lot of these companies are bullies and unless you stick up for yourself they will just carry on bullying. Good luck. PP

    good to see you back, we missed you lots, i mean i had to find all the links myself and couldn't find the letters that you just pull out of the back of your hat! Hope you are feeling a bit better now and everything is peaceful at home. Now that kiddles are back to school, life should assume a slower pace for you. Take care

    just an update and some questions
    Next have cashed token payment but i have heard nothing else
    Hbos overdraft still same 2 letters saying i will be charged daily fee for being over overdraft limit
    Mbna cannot find me in their system and i have to resend letter with further details? (how on earth can they not find me?)
    Hbos loans called me yesterday at home have not yet got token payment but have put 30 days breathing space on my account i simply quoted my cccs ref no and gave them the number to ring.
    Additions and Very catalogues part of littlewoods have sent 2 letters today saying they will not accept the token payment as it does not reach min payment amount and i have to contact them within 7 days.
    So do i call these people?
    My mum was visiting at the weekend when hbos rang it was awful felt so ashamed :-(

    Stop feeling ashamed, you're dealing with it.
    I would just ignore all of the above, CCCS will deal with most of it at this stage, its just the creditors being unreasonable and jockeying for position, none of which will make any difference to CCCS who will just send them the agreed payments. your DMP will go ahead, whether they agree the payments or not (they always want more), so they would be better to just let you get on with it. Try not to worry, it always takes a couple of months for it all to settle down, I think creditors think you are at your most scared and worried at this point and they tear into you to try to get you to pay more. You'll learn and become much more savvy as the months go by and realise that actually there isn't really a great deal they can do, you're trying to pay it back and you've sought advice. At this point there is no more you can do. So please try to relax and let CCCS take the strain for the moment, if they are still not playing ball after 4/5 months, then you start to complain and loudly but that is in the future, relaaaaaaaax

    Hi everyone,

    I haven't posted in a while but I have been reading most days. I am becoming increasingly curious about the CCA/UE or whatever the abbreviations are!

    What makes an agreement unenforceable? Some mentioned pre 2007. Does that make it more likely?

    My DMP is going OK though, and I am living well on the budget. It has been an education for sure but I would not change the last 6-8 months as I have got over my materialistic ways, it has been like therapy or retail rehab! Truth is, my £4 jeans from Primark ARE as good as the £59 Boden ones! We have had an amazing summer with a £63 National Trust membership and a picnic hamper, and there are loads more autumn events to come. Good times are worth so much more than a house full of clothes, cosmetics and overpriced junk.

    BUT, back the point. Although I am responsible for running up so much credit, I do feel some my creditors acted very irresponsibly in giving me HUGE credit limits, while I had other cards/catalogues. Then they sit by and do nothing while I obviously was in trouble as I was bouncing credit card cheques between them for a few years while not working, before they finally pulled the rug a month before Christmas last year. For that reason, I am curious about whether they are all enforceable.

    Anyway, I am going to check out "niddys" info to see. If anyone can throw out some info on here about it, please do.

    Good to see some action on here again, its been a quiet summer!
