Hi again, E2 did i read a page or 2 ago that you've requested a CCA? If so or indeed anyone has does it give the date the account was opened. I've got a feeling one of my accounts might be pre 2007?? ummm scratchy head?

I hope someone can help me this morning, I've not posted in a while as my debt management plan seemed to be on the right track and I'm about 4 months in now.
Some creditors are still not co-operating however
Tesco's credit card are refusing to stop interest as the payment that CCCS are making meets their minimum requirement and as such I am not in any kind of financial hardship.
Post Office credit card are adding £12.00 in fee's every month as they say I'm £90 in arrears. Unless I pay the £90 they will not even consider the CCCS's offer or considering stopping the fee's and interest. I've written and ask ed and that was there response.
HFC Bank are denying even hearing from the CCCS despite it being 4 months down the line.
This is starting to stress me out again and I was doing so well at least I thought I was.
It's a bit of a lottery Good Egg, some freeze immediately, others take ages, there is no pattern. Egg, MBNA and Citi all froze for me, but BoS were a nightmare, I just continually hassled them, went thru their complaints dept and eventuallty they relented, you just have to keep fighting and you will get there in the end. Don't just write to the post office collections department or the general address, find where you send a complaint to and make sure its recorded delivery.
Put in the letter everything that has happened, really go to town on it and what you want the outcome to be, stopping the interest and charges and a refund of all charges levied.
You might not get everything back, you might get nothing back, but they may stop interest.
If they don't stop interest you could escalate the complaint to the Financial Ombudsman. Worth a shot don't you think?
Have a look around the National Debtline letters. You have to be proactive sometimes, CCCS can only do so much and it will make you feel better writing the letters,I'm Debt Free :j 2/09/2013

The financial Ombudsman was my next step with BoS. Try them, I've seen a few posts on here from people they've helped re. interest. PPLBM Jan 2010. DFD 2016. :think:

Hi all, want some advice please. Most of you who've been on here a while know my situation, £50k debts, 6 year DMP going well (5 months in), all creditors frozen interest.
Am seriously thinking about taking the unenforceable route like Dopey, have joined Niddys UE forum (he is fantastic) but tells you it can be stressful, that you have to be totally committed to it, have to stay strong and follow the prescribed path.
I am still not 100% sure that I am ready to do it yet and leave Payplan. I have a big mortgage, young family, etc and that is on my mind plus the fact that the DMP is going well. Any views very welcome, cheers. PPLBM Jan 2010. DFD 2016. :think:

prof I've replied on your thread on Niddy's site.
If a creditor is still adding on interest and late payment charges when you are on a DMP you can complain, a lot. There are guidelines that say they shouldn't compound your hardship. I was having this problem with Amex, still adding interest and ignoring all pleas not to, one of their foreign operatives actually told me that because they are an American company they can do what they like and don't have to look to any British guidelines. the thing is folks, they lie, they cheat and they bully, if they won't stop interest/charges phone the Financial Ombusman and COMPLAIN it is very simple, just a phonecall and they then write to the company, Amex apologised, refunded all the charges and interest and took an extra £50 off the balance for my trouble and they had a complaint logged against them. Actually it is almost your duty to complain, if they think they will get away with atrocious behaviour, they will do it all the more, so get on those phones tomorrow and COMPLAIN!

glad to hear the unenforceable route is going well for you. I might have one out of my 3 creditors that are UE. Can i still carry on my DMP if i take the route with one of them.
First of all i have to find out when i opened the account terrible but i can't remember when it was opened. I have a had a good read through the UE posts and i find it all very scary and a little baffling.
Is the the very 1st step sending off for the CCA?

OK, it is difficult to check UE if you are still paying, even through the DMP, mainly because the creditors don't really take any notice. However, nothing to stop you asking for a CCA, but if comes back looking as if its UE you would have to stop paying then.
Its really quite simple, they must have certain prescriptive bits in the agreement and they must have an agreement, if they don't or it doesn't have all of the bits, its unenforceable, which means it can't be enforced in anyway, ie court. They can still default you and write scary letters and phone (but never talk to them), but they can't enforce. PPP, I'm in the same boat as you I'm so tempted by UE but not sure I'm brave enough for it. I probably wouldn't even be considering it if it weren't for banks like TSB and Halifax that are making this whole thing so difficult.0
