  • Hi me again

Sorry just having a panicky moment!!

Been reading some posts on different forums and some scary stories. My main worry is that the creditors wont accept the DMP as seems small amount that payplan are offering and debt large amount.

Has anyone had any dealings with RBS (main debt) and Cap one? Really dont want a charging order on the house as do have equity but the house is in joint names and debt is mine.

    Starting to worry

Sorry for the rant but its nice to have somewhere to rant to!!

    xx

Don't worry, it's incredibly difficult for them to put a charging order on your house. You have to default on a CCJ first and if the mortgage is in joint names they can't do it anyway.
I think maybe you are getting a bit of the normal pre DMP nerves, we have all been there, it will all be fine. Try and relax if you can. PPP

Freshstart2010 I have been where you are reading and researching and everyone on here will agree with me that I was in jeopardy of making myself ill, thinking of Bailiffs, Loosing House and all what you are suffering from.

But you know what if you read some of my previous posts on this Thread you will see how anxious I got. At this moment in time I feel great and tell myself I am paying my debts but on my conditions and not the banks and what I have not got they cannot have.

Everyone on here is very supportive and have helped me to this point.

Ring all your creditors and explain your circumstances.

Tell Creditors that CCCS have advised you that you ask for your telephone number be removed from your account and everything needs to be done in writing

Explain that you will be sending a token payment and ask for the address you need to send that payment to also ask them to send you a statement.

Tell them that once you have your CCCS ref number you will send it to them immediately.

Ask them to freeze the charges and interest as these are just compounding your financial problems.

Send a letter with a token payment and include all of the above (see the template).

I waited about 3 days and rang creditors to see if token payments had been received.

Barclays - Froze interest and charges for 14 days until I provide CCCS ref number then they will assess the offer CCCS put forward.

    Northern Rock - As above

    CITI - As above

Next - Accepted token payment and want us to contact them with CCCS Ref No.

    Co-op - As Barclays

None of my creditors have been threatening or angry they all understand and have been very sympathetic and all advised me that they are aware of CCCS and will work directly with them.

Freshstart2010 I think as long as you ensure monthly payments are made none of your creditors will seek a Charging Order. If you have a DMP in place and are maintaining your monthly payments any court in the land will side with you.

Its early days for me but I am more positive today than I was last weekend I was ill with worry but today I am better, stronger and ready for the fight and that is down to my way of thinking and the others on this site. I know that It will be tough but I will offer what I can that is all.

Look at what you have in your life - health, family the things money cannot buy especially love and no one can take these away from you they are the things that are precious.

Remember they cannot have what you have not got.

I have been where you are and have moved on.

Couldn't have said it better myself MIKON !!

Another thing worth remembering is it's often the creditors you owe the least to who shout the loudest, and it costs them a lot of money to take you to court I believe so it's just not worth it for the majority and once they see you are making regular payments they calm down.

Hi tedsd and everyone, I'm fine havn't been on much lately, have been hanging round on e-bay and managed to flog a few things, have more running just now, between DH and self have managed to make £270.
Not bad for stuff from the back of the closet, that you "never know" might fit again some day, also clothes and shoes that caused this financial mess in the first place and never been worn, on to household stuff now. Fingers crossed for the next lot, WHY did I ever keep any of it. ;o)

    Afternoon everyone

Just had a phonecall from Santander about my cc. She was very demanding at first saying I had to pay this, that and the other (which I haven't got) and as soon as I mentioned CCCS and gave my reference number her tone changed completely and she couldn't have been more helpful. Although she did say that they hadn't received my letter saying"i'm in a dmp" which is slightly worrying.

The charges and interest will remain but no more calls will be made for 40 days until the DMP is set up and then interest and charges will stop. I paid a token (and she said to keep doing this no matter how small) so thats one done. Quite a few more to go.

Why oh why didn't I do this earlier, i'vebeen scared witless about a DMP but the whole system is geared towards getting you sorted out and it seems to be working at the moment.

    A slightly happier Eyeopener today.

sometimes its better to talk to them, I have spoken to any of ours who have phoned and no one has been nasty. the golden rule must be that you don't let yourself be bullied into agreeing anything and that you are calm, assertive and organised. Well done, one down.
