You're wrong about the council tax, all/any adults living in the house are liable for the council tax.

The OP may have issues with claiming LHA (this is the replacement for Housing benefit) as her parents own the house she lives in and there is no current tenancy agreement, it will certainly not be striaghtforward as it could be investigated as a "contrived tenancy".

    Sam

But I would be claiming alot less than my LHA? Does that not mean anything? And there wil be a current tenancy agreement before I approached them.

I rented from my father a few years ago. It was slightly more difficult than a straight-forward (ie anonymous landlord) tenancy but not much. I had to show the tenancy agreement and get a letter from him saying that without rent he would not be able to cover the mortgage so would have to evict me. I seem to remember it took a little while to come through too but was all back-dated.

I'm sorry you're having to go through this but it sounds like you've made the right decision. Things will get easier

  • Hi Emsy. Hugs darling, what an awful thing. Here's my two pennorth...

    1. You will cope, I did when XH did a flit and babe 3 months old. And I'm crap.
    2. Glad you told your folks. Can you get your Dad round to change the lock barrels? Not hard or expensive.
    3. If you decide the babe will be better off without an alcoholic father, and you are not married to him, consider whether you want to put his name on the birth certificate, if you do, he has parental responsibility and is entitled to seek contact. eta if you're not married, he has to be present anyway to put his name on.

Hugs hugs hugs, you will cope. And you may not get too big to drive, I didn't in either pregnancy and I'm big anyway.
Please do not confuse me with other gratefulsforhelp. x

I thought he had PR regardless if on BC? And I assume if he is not, I cannot get maintenance? but if that is the choice, i will go with out the money, how un-MSE is that :o

He only has automatic PR if you are married to him or he is on birth cert, and you are right, no PR (or proof that he is the father) no CSA. The reason I ask is looking back, if I could have chosen, I would have gone for "father unknown". May be different for you, though.

eta word of caution, this is how it was when I went through this 7 years ago, it may have changed. Maybe see a solicitor to check when dust has settled? You're younger than I was I bet, and it will all come out in the wash, I promise.

There are plenty of people with no parental responsibility who have been chased by the CSA for maintenance.

  • Aint that the truth, including one of my good friends, if he hadn't been so lucky in a very calm and trusting wife, it could have been curtains for his marriage.

There is a distinction, though, between being chased by CSA and the CSA being entitled to chase you...

They are entitled to chase you. If you dispute parentage then you are entitled to requesting a DNA test.

(you everyone not you in particular :))

Thats very true as my ex who I have split from recently, split with an ex girlfriend when she was pregnant... roll forward to when the baby was born, he refused parentage and was forced by the CSA to take a paternity test, which of course can back positive, he was just trying it on. And the whole time he denied being the father, the CSA payments stacked up and he had to pay all the back payments when it was proven he was the father.
