    Hi Guys, don't know if this has been mentioned before, I have only had a quick look through all the posts.
    My wife got a PCN from Vehicle Control Services July 2012, she is the owner of the vehicle but she was not driving, anyway after looking on here and other places I have just ignored all letters she has had, however last week we got a letter from roxburgh debt collectors, we chose just to ignore that as well but today they actually phoned her on her mobile, they wanted to confirm her address to make sure they had sent letter to correct place, she confirmed then got her wits about her and said she was not driving and how did they get her mobile number? it went quiet at other end so my wife just said I will be speaking to my husband about this and hung up.

    Hopefully that will be the end of the matter, but if by some chance they DO ring back, the standard jargon is:

    "The debt is denied. Under Office of Fair Trading guidelines you must now refer the matter back to your client. Any further contact from you will be considered as harassment and action may be taken against you, the parking company, AND the landowner (stress this bit!!) in line with the Protection from Harassment Act 1997".

    Then end the call, no conversation at all.

    My my, they must be getting desperate placing cold calls after such a long time. Hopefully times are hard in Roxburghe Land. Very very hard indeed.

    Search this parking sub-forum for the keywords 'Roxburghe phone calls' and you will find lots of other people who have had this hassle and knocked it on the head easily. It's just a matter of responding with the right reply, see the other threads as you'll feel better when you read about other people doing this first. Just DO NOT BOTHER to look at the youtube result as the guy did not follow the right 'script' and it's stupid.

    The DVLA do not give out phone numbers but obviously yours comes up with a basic Google or a limited credit search maybe - sometimes your bank puts your phone number on the record of any loans. And Roxburghe can look at some basic stuff, that's how they get the numbers of some people.

  • Just a quick thanks to everyone for their advice on here.

    I've just had my second letter from DRPL after getting a ticket for 'leaving the site'.

    I've just replied to DRPL on e-mail stating -

    "Sir/Madam,

    This is a formal notice under Section 42 of the Data Protection Act .

    You have 21 days to respond to this request.

    I have reason to believe that you are holding data about me without my consent and holding this information is causing me distress. I do not have any contract with you and you do not have any reason necessary to protect my vital interests you should therefore remove my data.

    If I do not hear a response from you within 21 days I will raise this matter with the Information Commissioner's Office."

    Not sure where it will get me but as far as I understand I have nothing to do with DRPL and they can't hold my details.

    Anyone know if this is correct? I'll keep you posted on how it goes.
  • Just had an email back. I think they may be ignoring my request! I've responded saying that they have 17 more days to comply :-) I'll keep you posted....

    The site in question is subject to terms and conditions which are stated on signs throughout the area.

    Parking restrictions are put in place for a variety of reasons; including traffic control, congestion avoidance, etc and, as such, must be strictly enforced.

    As these terms were breached on 19th October 2012, a PCN was correctly and legitimately issued.

    Please find attached photographic evidence taken at the time of the contravention.

    I would like to make clear that Debt Recovery Plus Ltd is a legitimate debt recovery company (registered with Companies House) and along with our client are members of the British Parking Association (BPA). Furthermore, we are enrolled on the Data Protection Register (Reg No: Z1583570) and, as such, are authorised to request and handle the information in our possession.

    I understand that this is not the desired outcome. However, unless further evidence is provided, the decision on this matter is final.     As a gesture of goodwill, I will place the account of £150.00 on hold for 14 days to allow time for payment to be made.

    However, if no payment is received within this period, the matter will be passed on to our solicitors for further action to be considered.

    They have ignored completely what you have said, be interesting to see if they even know how to reply beyond the stock appeal failed the charges are legitimate give us lots of money!
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    So does that make it a contractual penalty then, as oppose to a sum to cover the landowner losses?
    From the Plain Language Commission:

    "The BPA has surely become one of the most socially dangerous organisations in the UK"
