  • Everyone I had asked are all afraid of the same thing.... receiving CCJ's, etc..... thank you for the advice... I will be reading as many posts as I possibly can to assess the legality of the ticket, the company does seem to be legit yet that seems to be a common theme so far, I will try to keep the forums updated on the matter as others have and hopefully my dilemma will help others too.

  • Since I recieved my parking fine back in feb of this year from a private organisation (dont know which one because the correspondence is signed from the university, which is the car park i was parked on whilst i was trying to obtain a permit as my sis had an interview) it is still hanging over me.

    Was advised to contact Trading standards but they only advise on council tickets not private organisations.

    I have appealed and they rejected it. They wrote to me again with a final warning then gave me another chance to appeal, which I did.

    Guess what happened next......they said that i had already appealed and it was rejected and tried to find all excuses to point out that i did this deliberately. Im totally confused, my sis gets invited to the interview, they dont send out parking permits in the post, can only be obtained via uni reception, goes to collect one and gets a ticket....is that me asking for it????

    I have now recieved a final warning letter telling me to pay £15 for admin fees as well on top of the fine.....ludicrous or what! so thats a total of £75 and if i dont pay within the next 14 days the university will obtain a CCJ.

    I have read on here to just ignore these statements but seriously just want it reiterating if thats the case.
    Can anyone help with this at all pls???????

    CCJ's cannot just be obtained at the drop of a hat. The law doesn't work like that. The only way that the Uni. (or the parking company that is employed by them) can get a CCJ is for the case to go to court, you lose, and then refuse to pay whatever the judge orders.

    So, in the unlikely event that it does get that far, you will have the chance to put your side of the case to somebody impartial. This is in contrast to the so-called "appeals" process which is run by the very same parking company that issued the ticket. It's in their interest to turn down all such appeals , otherwise they wouldn't make any money.

    'we would ask you to consider the implications if the case is heard in a county court and and CCJ is successfully obtained against the driver:
    addtional court/solicitor fees would be incurred and added to the outstanding debt
    would affect the drivers credit status
    warrant may be issued and a county court bailiff to collect the monies

    The usual hollow threats. Many other people have received similar letters and it's come to nothing. What company sent this out? We like to name and shame on here.

    For a start solicitor's fees cannot be claimed in the small-claims court.

  • Im all up for naming and shaming but even I dont know the name of the company, all the letters of threats I have recieved are from the University of Bradford on their letter head signed from them, so the company working on their behalf dont have the courage to tell me who they are :mad:

    Make a request to them demanding to know name of the actual parking company involved. I am 100% sure that there is private parking company behind this. You can tell by the wording of that letter. It's identcial to the usual rubbish sent out by PPCs/debt collectors.

    After a bit of detective work I have found out who the PPC is. It's actually Car Parking Partnership . You can tell it's them becuase right at the bottom of the University's parking T&Cs there is a Northampton address. I Googled that and up came that PPC's website.

    So now you can safely ignore them. They never do court.
