It is quite rare though, and obviously it IS illegal.

Most of these banning notices ARE just scare tactics. And I'm not aware of anyone being towed as a result of receiving a banning notice as such. But I have seen cases where towing has happened in respect of unpaid invoices. So its not impossible. Just rare.

God, we all know what the police think in regard to this stuff, don't we? Two words, 'matter' and 'civil' and not necessarily in that order.

It's as rare as rocking horse sh17.

No 'reputable' PPC would do this as they would be in for a severe spanking. BTW I use 'reputable' solely in the sense of being 'sue-able' ie they have assets, bank accounts and named directors etc that legal action would be used against.

In addition no 'reputable' landowner [same definition again] would allow it to happen [at least not once they'd been spanked badly in court.

So chances of it happening are so rare as to be non-existent, imo.

It's almost unheard of, but NCP did it, actually towed a car away for 'unpaid tickets'.

The car has been returned on the order of a judge and there's a Small Claim pending - to be heard in the Summer:

Should be an interesting one in the end, especially with the VCS decision to add to the mix!

Hi all received a parking ticket today after calling into an Asda I had never been to before so didnt realise it was a pay and display carpark! The carpark is apparently run by the local council according to signs and the logo on top of fine has a local county council logo.
On the back of the ticket it gives the following website address to contact them www.wppp.org.uk
Just like to know if this is genuine really as some people have questioned it?
    Thank you

The logo and the website tells you this is a real Penalty Charge Notice.

If you want to appeal that - and most people do actually win - then I would register and post a new topic on pepipoo with pictures of the front and back of the PCN:

    http://forums.pepipoo.com/index.php?showforum=30

Check the back of the PCN. If it says they will usually re-offer the discounted penalty if they reject an early appeal received before day 14, then you may as well try an appeal rather than rush to pay!

But get help from pepipoo by starting a thread with pics. Look at a few other threads first to get the gist of that forum and then read the FAQs such as 'how to post pictures'.

HTH and good luck with it...not relevant to this thread though as it's a real one.

Sorry, I didn't mean to set hares running here.

I'm only quoting what it says in the banning notice guys and to reply to a point made that the red letter is the last you'll hear...

    Chill out :)

No great problem, but you definitely need to have a reality check. One of the first things you need to realise is that what these companies SAY they may do is a million miles from what they actually could or would do. Do not fall for their bullsh*t.... for example, Graham White tells everyone he writes to that he's going to take them to court... actual number of cases brought = zero.

Telling lies to try and scare you into paying is standard practice for these people.

If you actually know first hand of someone it's happened to then we are going to be keen to hear; otherwise, it isn't helpful to repeat their garbage.

Oh, Coupon-Mad has beaten me to it!

From what I read of that it was some maverick at local level who did that, rather than anyone in authority at NCP. They don't even do court, so the bosses may not have been best pleased.

Coupon, NCP aren't really caught by the VCS ruling as they generally are the car park owner and are thus acting on their own behalf?

I think in the linked thread where NCP towed a car away it was from a station car park or somewhere they don't own (not sure where as I don't fancy reading it all again!).

I do take your point that where they own the car park they have a slight advantage over other PPCs as the VCS ruling probably doesn't apply. But then they still issue rubbish fake PCNs, their signs have not been known to be very well written from a contractual point of view and there's always the penalty, harassment argument against them too of course.
