Roxburghe are the next step in the scumbag plan. They have no powers whatsoever and will do nothing other than pass the file to another desk in the same office, which uses "Graham White" (Phoney Solicitor) headed paper. After a couple of Graham White (Phoney Solicitor) letters, you will be left in peace and never hear from them again.0

Just wanted to udate on my earlier post and paperwork uploaded kindly by Crabman - I have had no outcome to completely ignoring the letters. Stick with it :-) Thanks for all the advice on here and help - cheers!0

In my experience you will hear from them again.
They seem to be issuing "banning notices" to car registrations that have failed to pay up attached to it is an invoice for whatever they believe you owe them,. In essence, this is them telling you that you are banned from all of their car parks and if found they will tow your car and ony release it you if you settle the full amount.
It's at this poin that I no longer play the game, because it then becomes a grey area from what i've read and seen happen to others. Police will not get involved generally so you have lost your car and have no support to retrieve it unless you pay up.0 -

What?
Someone steals your car and asks for a ransom for it to be returned and you say the police will not get involved??
A court claim against the PPC and the landowner would put that problem to rest surely? If they take the car, the victim can hire an equivalent or keep taxi receipts as well as any other losses incurred.
Once you file a claim with the PPC & landowner the court will examine the PPC's alleged debt and as usual find the debt has no basis in law. You get a payout from the landowner (let them learn the hard way) and the PPC risks losing their contract with the landowner.
If it was legal to seize others' property just because you feel they owe you money what exactly would be the point of having the civil justice system?0 -

What on earth are you talking about?! This 'towing away' by ECP does NOT actually happen!
Oh the 'banning notices' you mention have been tried by ECP as I have seen a couple of threads about these on pepipoo. It was quite amusing to read about seeing as ECP can't tow a car - they have no SIA immobilisation licence so can't clamp either. And neither sanction can in fact be applied lawfully for an alleged 'unpaid debt' on land the company don't even own - that's against the law.
It was all empty threats and intimidation which got them reported to the Police and the Sainsburys store manager (shame no final outcome posted but here's a recent example of ECP's unusual attempt to frighten someone):
http://forums.pepipoo.com/lofiversion/index.php/t67596.html
And anyway, clamping, blocking in and towing will finally be banned in October.
And this sort of notice has only been rarely posted about, by people who have collected dozens of fake PCNs in the same car park (= taking the mickey really). NOT people like me who have just ignored one ECP fake PCN!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Sorry, I didn't mean to set hares running here.
I'm only quoting what it says in the banning notice guys and to reply to a point made that the red letter is the last you'll hear...
Chill out0 -

No probsit's just the final paragraph of your post that made me wonder why you felt police wouldn't get involved with the unlawful removal of a car by a private company in absence of a court order.
I'd be surprised if any such "banning notice" was sent with the knowledge and consent of the landowner0 -

This is not a grey area and it is crystal clear. They cannot tow your car because of unpaid invoices unless they have been to county court, won, you have not paid within 28 days, a CCJ has been issued and they have then gone to court to be able to enforce the CCJ. Only then could they try and seize your car as settlement of the order made by the court. But they have no legal powers to tow it because of unpaid invoices."You should know not to believe everything in media & polls by now !"

Ghostrider is simply stating what will possibly happen as per their own 'banning notice' - I don't think he's necessarily stating that it is legally correct. PPCs have been known to do this, and the police have been known (more often than not) to not want to know.
We all know that this flies in the face of legislation, but its a fact, it does happen.Je Suis Cecil.0 -

Thank you,
As I said I had heard of it happening and police disinterest, and so thought it best take heed of the letter in some sense and avoid losing my car temporarily and having the hassle of it all.0
