    No they don't have to prove it , it is actually not relevant , they have to prove their claim.

    That said as these are civil proceedings the standard of proof required is balance of probabilities.

    So, since you have attended court what are the chances that you received the court papers but not any of the PPC letters ...on probability the judge is unlikely to believe you so you are off to a really bad start defending your case ..you want the judge on your side !!

    And, no, the court papers are not sent recorded delivery ..they come standard post.

  • We have just received a rejection of our appeal today from Vinci Park Services Ltd on behalf of their client St David Ltd Partnership. We paid £5 and displayed, when we parked visiting the Atrium in Cardiff, but as it was a 'non-stick on the windsreen ticket' it must have blown to the floor from the dashboard when taking coat, or shutting the door. We have the ticket to prove it was purchased on the day in question at 12.00 and this was copied with the email.

    They are asking us to provide payment of £100 if received after 14 days otherwise £50 if before.

    As I understand it, you have proof that you paid the required fee to park and you've provided this evidence to the private parking company, yet they are still asking for £50 or £100.

    In this case, it would appear that Vinci are just another cowboy outfit. I'd ignore further threats from them as you have been perfectly reasonable. They will no doubt threaten court, bailiffs, credit record entries, etc. to try and scare you.

    Next time they write, just chuckle to yourself that these scammers have the IQ of a cactus plant and were too stupid to get real jobs like the rest of us.
