ooo while we're on work talk...if the timing works out, I might be interested in applying for an internal promotion-post to start when I go back to work. Can I apply while on ML? Can I start it straight away upon going back? I'm assuming that it would "start" when I go back and not somehow magically while I'm still on leave giving me more pay...Also if I do apply/want it, can I do it on the stipulation of flexi working arrangements only?

There would be discrimination outrage if employers assumed just because you have a child you can't work the same hours as you used to! If you don't want to work those hours, it's up to you to request/arrange a suitable alternative, be it in the same role or otherwise.
My post had nothing to do with employers assuming anything - if CSH was happy to return to work at those hours then it would be a totally different matter. Everything I said was based around the fact that she is requesting a suitable alternative and having very good grounds for having it granted.
Most employers, particularly in my field of work (retail) are reluctant to do anything that could potentially give them bad press without very good reason. I think giving a new mother who has requested flexible working the option of such a long working week or nothing would (rightly or wrongly) fall into this catergory in todays climate, especially when similar things are in place in other areas of the business.Mummy to Thomas born April 27th 2010 8lb 5oz0 -
Aless, yes you can apply and if you request it, your employer should make you aware of any vacancies that arise whilst you are on mat leave. However, if the job was due to start whilst you were still on mat leave, I would be surprised if they would wait several months and hold the new job open (however Glam has proved that if you are good enough, some employers will wait for you! Well done Glam!!). Obviously they would not say they won't hold the job for you as you would be discriminated against though - you would just be unsuccessful.0

I don't know, but I would imagine that if they refuse your request, and you lose your appeal, they would not have to offer you another job with those conditions. They only have to offer you a job with your existing conditions which we know are no longer suitable anyway, and as you said, there aren't any others. However, it would be in their interests to retain you in some form due to your experience and the cost of training new people surely?
Have you had any enhanced maternity pay from them, and if so, would you have to pay this back if worst came to the worst and you did walk away?
No enhanced pay ROFL at the thought! They work to the letter of the law and no more. Really bad to work for employment benefit (and lunch break!) wise0 -
Aless, yes, you can apply whilst on maternity leave. I'm not 100% but I would assume you are "in" your old role whilst on maternity leave and would have to return to work (or at least return on paper but be off on paid holidays) to switch to the new role and receive the pay (are you on enhanced maternity pay too?).
How do you get on with the managers/HR? I'd suggest you sounded them out first as to whether they would be likely to accept a flexible working arrangement (what do you have in mind exactly?) and potential delayed start (if they want someone next month but you don't want to go back for another x months yet) to see if it's worth your while applyingThey can't block your application on the basis you want flexible working but they could just not give you the job if they can't accomodate such a request.

Aless I did when I was on maternity leave with ds1. Had the interview while still pregnat actually and the post started when I returned, conveniently!
