    Right you may be ok then, i'd be looking for two lots of terms with HSBC (i.e the original and the variable when they changed names) PLUS, being 1st Direct only formed in 1989,lots of their first tranche agreements were quite a mess, so its not all doom and gloom :D

    Love the idea of Woodstock 2010! Wonder how many of the original performers are still alive, though?

    And I was one of the first customers of First Direct - think I joined them around 1991. I have to say that parting company with them was quite a wrench because they have been good to deal with. Apart from their interest rates .....

    I expect this is going to change very soon, though!

    Hi everyone - and Mouseann, I hope you don't mind me coming on to your thread? - I have only just found this amazing thread and wonder if there's something I can do about my situation too.

    Im 64 and on basic pension and pension credit only, no savings, no money,no assets. Five years ago the company I was working for went into liquidation and I had several debts, totalling about £45K. After a few months, on the advice of the Halifax, I contacted Payplan and now pay £43 per month to 2 credit cards (Halifax and Mint), 2 loans (Halifax and RBS) and overdraft (Halifax). Some, if not all, are now with DCAs.

    Apart from the fact that I would very much like to have this £43 per month for ordinary living, I will NEVER be able to pay off these debts because I simply won't live long enough.

    I am reluctant to go down the bankruptcy road, especially while my parents are still living as they would be horrified. I understand that Payplan cannot advise on Unenforceability which I suppose is why I hadn't heard of it until a couple of days ago.

    So, my question is - would it be possible to apply for the CCAs without messing up my arrangements through Payplan? Obviously I wouldn't want to put these arrangements at risk if there's nothing to be done.

    Hiya

    Part of unenforceability means you must cease repayments otherwise you have nothing to hold over the creditor. Therefore, being you cannot cease repayments with a DMP it is not recommended that you advise them, however being you'll be making payments the creditor will ignore you.

    So, what to do is send the CCA requests for now, make the next monthly payment and let me see what they send back. If it is unenforceable then you have to stop paying, but then you switch from payplan to CCCS - they both do pretty much the same.... in fact don't payplan take a percentage from the amount you pay them? Or not? I dunno how they work, but don;t worry cos you can then cancel your agreement and continue with CCCS if it comes to that.

    Oh thanks Nid, that certainly does make sense. I'll get on to that ASAP. No, it costs nothing to go with Payplan. Meanwhile huuuuuuuuuuuuuuuge thanks.

    Ooh Nids will be offline for a while with the Rangers v Celtic game. Celtic had had scored when i last looked in on my son and friends!!!!! he of course supports the green hoops and his two friends the blues thats when i deided to retire to boudoir!!!!!!

    Good to hear from you. And glad to know that I am not the only person to have "mucked up" my retirement plans!

    I am sure NID will look after you - his advice is very sound, he has helped so many more people than just me! You are in very good hands with him!

    We are all Rangers supporters on here now - courtesy of Niddy. Don't get Sky Sport (my house is a sport-free zone) so don't know what the score is. Hope Rangers win - for Niddy's sake!

    Had a call this evening from a company called alied (dont they sell carpets)who said they had tried to contact me loads????? i cant recall having any letters or calls from them they said they were acting on behalf of llyods for my overdraft. I read the statement that Nids gave me to read out to them and have to say they were NICE! they said they would write again. I know o/d's are not covered by enforseability so lets hope they remain civil.
