  • Well I replied to them before I read the advice on here.

    So I was just replying to a thread as a person who had tried to 'appeal' but has now decided to ignore them, just offering some insight on my case and what I shall be doing now, which is ignoring them. A lot of people come on here for information, reassurance and maybe other people are in my situation too, trying to ignore them after already making an initial appeal.

    To be fair, if you're directed here from a google search (like I was) it may take some time to find an "Ignore any letters" piece of advice.
    Furthermore, it 's also not obvious from this thread that there are sticky posts (other than by going through the messages)

    Finally, please be patient with newbies :A

    Hi flyfree, dont worry at all about any bunk junk mail from the desparate robbing scammer parking eye, there part of the scum of the earth, IGNORE everything you get no matter how official there begging letters look treat it as you would emails from nigeria saying you have been left £100,000 or more in someones will so please send your bank details so we can pay the cash into your account..... parking eye and all ppc are scammers like the robbing ghoons in nigeria! IGNORE and enjoy useing there begging letters for emergency toilet paper they will give up and try some other soft touch. spread the word about this forum and help put ppc out of buisness of scamming lovely people:D
    PPCs say its carpark management, BPA say its raising standards..... we all know its just about raking in the revenue. :eek:

    Hi All,

    Like many previous posters here we have also received an invoice / demand for payment / whatever you want to call it from Parking Eye.:(

    The format of the letter is similar to http://www.scarletfire.co.uk/wp-content/uploads/2011/12/Parking-Eye-Letter-1-Nov-2011-50percent.jpg which is in one of the sticky post and was addressed to Mrs rafraf03 as she's the registered owner at the DVLA. I received it throught the post and didn't get anything on my windscreen.

    The way I see it, they have had to purchase that information from the DVLA, so point 6 in this guide now applies. I am happy to ignore anything they throw at us, but for my personal understanding, is the only reason for ignoring them that it would be difficult for them to enforce the invoice? I.e. they would have to prove in a court of law that you have entered in a contract with them?

    Would it be not easier to just say that Mrs rafraf03 wasn't driving the car that evening (she wasn't) and that we don't wish to name the driver / Can't remember the name of the driver (which they can't force us to do)?

  • Why waste the time and stamp. Usually no contact =3-5 letters. Contact=5-9 letters. Take your pick. Another thing to remember is that its possible to say more than you intend in a letter so least said soonest given up to paraphrase.

    Have a look here - http://www.oft.gov.uk/shared_oft/reports/unfair_contract_terms/oft311.pdf - page 40, section 5.1. Under contract law you can't impose "disproportinate sanctions" so Parking Eye's charges aren't legally enforceable, whether or not you've entered into a contract or not. All they can claim is any actual losses incurred.

    have now had 3 letters from parking eye
    1 from roxburgh debt collecting agency and now ..
    1 from Michael sobell solicitor of Graham white solicitors
    we have ignored all so far as the reg keeper was not the driver , the driver only dropped someone off and remained in the vehicle in an area they claim is a permit only area although it is conected to a pay and display car park that was full and gridlocked with parking bays marked out and no double lines etc. . apparent . this was on a car park attatched to a retail area which occupants visited briefly , 10 mins tops.. they sent 2 pics of the number plates but that is all that is shown not the driver ,no ticket was issued on the vehicle, the first letter arrived after the time for discounted price... lol... surprise
    I am not worried by any of these although with the last one to arrive I could do with some reassurance and advise
    the original amount climbed to £167
    latest letter total additional costs £207.25
    so they are now pursuing £ 374.25 .
    this letter is marked in big letters NOTICE OF INTENDED LITIGATION
    Should I be worried or just ignore this ???????

    Thanks FatAndy, that makes it a lot clearer. it's interesting to note that "Such a requirement will, in any case, normally be void to the extent that it amounts to a penalty under English common law." which again they can't enforce!

    No, don't worry, do the same as you have been doing and eventually you will not hear from them again. It is their usual scare tactics which they know will cause many people to cave in and pay up.
