    Thanks for that...

I find it amazing that supermarkets that value their customer service so much contract these cowboys to enforce parking restrictions.

I recently read somewhere (can't remember where though, sorry) that some retailers and private land owners, get a stake out what the PPC's are making?

I've made it my mission to inform every retailer that I will no longer use them as long as they allow for these 'companies' (I find it so difficult to call PPC's that as most companies actually do have morals and ethics) to mismanage their parking situation and in due course knowingly allow the customers to be later harrassed and threatened with claims of severe consquences. I am simply not willing to expose myself to the danger of being distressed as I fear this may have an effect on my health. Stress after all...is a killer ;)

    )

Some do £10 per paid invoice I believe! Others pay a monthly payment to the landlords. I have seen a copy of a UKCPS contract which says £3000 a year paid at £250 a month.
However that goes to the landowner so some of these retailers will be getting the flak, and getting nothing! Thats why its important to keep the pressure on its something to take crap when your earning from it, but if your getting nowt?

  • Hi there!

I have read the entire 17 pages of this thread after getting my parking invoice lol. took me a good 2 hours to throughley read every bit of detail, I myself google'd Parkingeye, a mere 10 minutes before I was about to pick up the phone and pay these theifs. However Im always a sceptic about things like this and I believe in gauarding my well earned cash, and hate being mugged.

I got my first invoice about 2 weeks ago, after returning from the garage after its 4th visit to the garage since early december, (The harsh winter took its tole on my old baby). Its set me back over a grand to get it back on the road, however i was in a delighted mood to have her back, i walk into my house, into my kitchen and my mum glances at me and presents me this ridiculous A4 peice of paper demanding £50 or 110 in about 6 days. It was unbelivable, considering the circumstances I had just got out of. But hey, life can be cruel.

I did overstay my welcome by a massive amount of time if im totally honest, but im only 19 and have only been driving for about 1 year, so my common sense only streches so far, and i didnt think i was causing any harm by parking in a HUGE I mean HUGE multi-store carpark, my car musta taken about 0.3% of their carpark. I parked it there while I went out and hit the town and picked it up later in the morning, It was completely unintentional I mean I didnt realise you literally cant park yer motor anywhere beside yer driveway in this country. I'm in the wrong for parking on private land, but I didnt think it would result in this kind of consquence (I geuninely hadnt seen any signs as it was dark and there are many ways of entering the car park), I would pay if it was something reasonable like 20-30 quid. but 110 is just unreal for someone like me working on a 150 quid a week salary.

The problem for me is the car is registered under my mum, and she is a very closed minded person when it comes to things like this, and gets stressed very easily over things like this and would just opt to pay for it, she said she would throw in 20 quid to help me out, so its only 30 for me, but thats not the point its the fact 50 quid is still coming out of my familys pockets. I said to her i'd deal with it, and now thats my second letter, as i said i was 10 minutes away from paying by phone i thought i'd give it a quick google. So she came home and I just said i had paid it when she asked. I really dont mind it damaging my credit rating even if that was possible which ofcourse after reading here, is near impossible, I dont believe in credit anyway. But she rambles on how it will effect hers, since its addressed to her. Another problem is if they send the debt collectors which again has never happened if im correct in saying, but luckily for me i dont own anything worth taking apart from my car lol so thats fine but i'd hate for them to take something of hers. Also since the letters will be addressed to her i have no way of identifying them as i dont know what the envolopes look like lol.

Sorry for the wall of text, just my 2 cents.

    Cheers all :) x

Your or you mother's credit won't be damaged, they say that to you because they are eager to get to your money and they will send a lot more letters and will make more untrue statements in their swollen and bizarre wording. Chances are that should they take you to court in an attempt to enforce payment, they judge will do them for wasting his or her time, simply because these invoices can't be enforced. Show your mom the Youtube clip, there you'll see what a real lawyer does to their pamphlets. Another thing and you probably already read on here, but I remind you of it: Your mom as the registered keeper didn't park the car there, that was you, but she's not obliged to tell them who the driver was and hopefully won't do so. By decriminalising parking they have opened the flood gates for the PPC's but it also means that the same ones can't 'fine' or send you any 'penalty notices' the only ones who can do that are the local authorities or the police. The police won't get involved because for them it's a civil matter. However, it is known that even they, who should be better informed about such basic legal issues, often advise people to pay for the invoice.

Parking eye have never taken anyone to court! They don't like court as they were sued for the return of a parking charge and lost! The only way they could damage a credit file is if they took your Mum to court, very unlikely, they won, highly improbable, and if the Judge ordered you to pay you never settled within 28 days a judgement would be entered against your Mum.

No debt collectors will come, it would cost them money! Even if they did they have no power at all, just give them the two finger salute!

However that will never happen all that will happen is that you [or your Mum] will receive a few letters from Parking spy, then their pet debt collectors, then maybe a mock solicitor, then nothing!

Unfortunately the envelopes don't really have anyway of identifying them, so I see your only problem is keeping them away from your Mum!
  • Hi there,

I am also having the same letters coming through from Parking Eye after not realising I had to pay at the car park on sunday night and staying there for about 3 hours.

Thankfully i read the forums and haven't paid anything but today I got a letter from Napthens Solicitors which had me a little worried.

    It states:

"We write to inform you that unless the said sum of £120.00 is paid to our Client within a final period of 14 days from the date of this letter then debt action proceedings will be commenced against you without further notice.

We would inform you that those proceedings will include a claim for interest under CC Act 1984 together with a claim for any costs incurred...."

Uptil now I was confident that they won't do anything, but this ones put a few doubts in my mind.

    What to do?

Relax and ignore, ignore, ignore some more.

    It's just a clever-ish use of words.

They say they will commence..."debt action proceedings" and leave you to infer [wrongly] that this means they will start court proceeedings.

    These are two different things.

Their "debt action proceedings' will consist of whatever they deem their 'debt action proceedings' process to entail...typically sending you other letters all threatening to take your house away etc....it most definitely will NOT involve court action [coz that costs them money and they won't win, and they know it].

So it's safe to ignore, ignore, ignore some more.

It's possibly bordering on misleading/illegal/unlawful etc but it'll probably scrape within the letter of the law.

Sorry meant to say....if you have 10 mins to waste write/call up the 'solicitors' and ask them what it means.
