I would draw the attention of readers to the difference in the status of the bailiffs in the different circumstances as described in those two paragraphs.

    Hi Stressedk,
I wrote to Borehamwood Shopping Park & complained about Parking Eye demanding money from me & that I was being penalised for my wife spending too much money in their establishment & they replied back that it was my wife's fault for overstaying in their car park & the signs were clear that there is a 3hr max stay. They said they have forwarded by letter of complaint onto Parking Eye (which I did not want them to do as my anger is directed towards them.Needless to say my wife & I will never set foot in there again. We shall take our money elsewhere.)
I have now received the second letter from Parking Eye with the two grainy photos of my car asking for £50 within 4 days or "the first of many additional charges will be made".
"If payment is not received we will pursue this through the appropriate channels"

    To other board members-:
The small print states "your details have been provided by the DVLA as you are the registered keeper of a vehicle which has been parked in breach of the Terms & Conditions of a private car park"

Is this have any legal basis ? Would this stand up in court ?
Have I breached any Terms & Conditions?
    Many thanks

    Best Wishes

They need to have signs up to inform users of the car-park of the time limit, in order for them to claim you broke the contract you create by reading the sign :P

I've not had time to read the whole thread but today, I just got home to find a "Notice to owner," with photos from Parking Eye in my mail.

It seems that forgetting part of my shopping and popping back to Aldi later to get it has earned me a ticket for exceeding the allowed time.

I'm certainly not going to contact them or pay a thing but I do note that the "NTO" says that they have already written to me about the charge - nope!

    Is this a new tactic?

Notice to Owner? Send it to your local council parking department and ask if it is to do with them. You might get an interesting reply.

The third one is usually the last one. We've all had them.

In fact I'm tempted to overstay in our local Parking Eye monitored "free" car park just so I can get another batch of those letters. They really are amusing.

I've just received my third letter this morning with FINAL NOTICE in big black letters stating I now owe £80 rising to £110 if not paid by 28th Sept.
It then states "if this letter is ignored we will have no option other to instruct our debt collection agency to secure immediate payment, commencing court proceedings through our solicitors if required"
I'm assuming this is complete rubbish & they will do no such thing ?
Has anyone ever heard from their alleged debt collection agency or ever received a solicitors letter after the receiving the Final Notice letter?
    Many thanks
