  • Hi,

Not yet, only just been passes, this is what I am on about timescales, been with the complaints authority since begining of Nov 09. They apparently do not have the authority to send someone to collect my file but the SRA do. The complaints authority have recommended that, but only the SRA can enforce it.

So in the case of boberick then, the case has been with the solicitor since September 08 so is it only in may this year that they could complain??

The rules show individual stages that have to be done within a certain timescale.

If all of these stages take the longest possible time the overall process would take 18-20 months.

This therefore means that a solicitor can have broken the rules well before the 18 months are completed.

Wonder why then they are holding onto cases (if that is the case as SOME are posting here!!) when they know they are in the wrong?

    Good question.

As they (Watsons) only get paid for winning a case you would have thought they would want to stop working on the case immediately and return the documents to the clients.

But as they have paid over to Loancheck for the case in the beginning would they then be able to get the money back from Loancheck (who are in administration or would this be from the one still trading!!) or would it be their fault for not getting the case in court in time? What would the Law society say on it? I suppose it would depend on what the contract was between Watson and Loancheck?

Also who holds all the documents? Didn't someone post that the administrators hold them all and yet one solicitor (who I do not think was Watsons) have told Lesley that they are working on hers haven't they and should get it over and done with within 6 months?

Yes. That agent was working on behalf of the solicitor and should have explained the entire process to you. If he assured you that you would pay nothing under any circumstances then the solicitor will have great difficulty in claiming any fees back.

Hi all, haven't been on for a while. Just been reading through this thread and got to this bit from petermb. Now this whole agent explaining things thoroughly is a bit baffling. I had an agent come to me who asked ME to explain this whole thing to HIM as he had never done this type of thing before neither had he ever heard of it. This was the first time he had ever been sent out on this type of thing, So to say it was a case of the blind leading the blind is an understatement.
This whole thing gets weirder by the second.

So a private investigator (investigating what???), come ex policeman signed you to the solicitors then and did not have clue what they were signing you up to so asked you about it. Very strange and did you not question it then? I think from then on I would have been checking them out moo cow. Maxdp also said that ex policemen were often the ones that called on people. SO you have no name of the company then and also no record of what was actually said about fees etc as Petermb has said in his post? This seems very odd to me.

Hi, he said he was an ex policeman turned private investigator and that he had been asked to present the documents and I was to show him any insurance cover I may or may not already have so as the solicitor could ascertain whether I already had sufficient legal cover (on my house insurance) or would need to take out additional insurance. But he'd never heard of ppi reclaiming and was intrigued to know what it was all about as this was his first time delivering documents relating to this type of thing. this made my hubby a bit unerved. I told him not to worry (oh what a brainbox i am!) as it had nothing to do with the agent. he was just being paid to drop off documents for us to sign. Now as I had already been, ahem, 'assured' many times that there would never be any cost whatsoever to us i had no reason to doubt anything at the time. (yes, I can hear myself hysterically laughing at that too). Still, we live and learn.
i wish I could find that card. I think it's been thrown out. I remember he was from Aberdare though.
By the way, reading down through this thread i'm interested to know how many success stories there have been aswell because i distinctly remember being told of the 'many' success stories where people had claimed back much more than just the ppi.:rotfl:
