I have just received a Parking Eye fine letter with photos of my car, and the number plate, but it is not possible to tell who the driver is. I went to a motorway services, did not see any warning signs - they were not prominently displayed. I had a long and leisurely breakfast and a chat, then left - I did not misuse the parking facilities - I was there solely to use the services. I had left home at 2 am, was at the services at 8.30, stayed for 2 hours 42 minutes, then left to continue my very long journey.
I will follow the advice offered in this forum and ignore the letters - wish me luck - I hope I can maintain my resolve!!!!0 -
You don't need luck.
Everyone ignores this junk mail series, it's just like ignoring some phishing emails. As long as you are the registered keeper (i.e. it's not a lease/hire car) then you can just file all the letters.
It was never a real parking ticket, not a fine at all. You owe nothing.
Just play snap with the letters, comparing them to any similar debt collector letter-chains used by any PPC listed in the third from top thread 'PPC letter chains'. They are not very imaginative with their junk mail, these PPCs, check out the letter chains thread now and watch the Watchdog clip on there if you've not seen it yet!

Hi,
I received a parking eye charge having spent 30 minutes extra in one of their car parks. The problem being is that I WAS back in time however due to heavy traffic (this happened on Dec 23rd) I couldnt get out the car park. I had two three year olds with me so decided to leave the car and wait for traffic to die down!
I went to Mcdonalds in the complex before again trying to leave. By this point I was 30 minutes over time!
Anyway I have been constantly replying to Parkingeye explaining the situation. They constantly ignore any point I make and have refused to drop the charge.
I have now been referred to POPLA and I have registered my appeal with them
However I received a new bundle from Parkingeye with evidence their case is built upon! Still ignoring any points I have made?
What do you think I should do? I genuinely came back to the car within the 2 hour time period but could not get out! I spent money in their complex whilst waiting!
I had obviously admitted to being in the car park for too long but have a good argument! Is this just scare tactics from them? Or am I best paying up? Are they really going ton take me to court????

You have received PE's POPLA evidence?
So you need to add to your own extra (strong) evidence, you should have a deadline by which to add in more information for POPLA. Add in more or you will likely lose at POPLA. You do not do this appeal alone - hope you haven't just based your POPLA appeal on the 'toddlers, busy car park, I was shopping' issues?!
Read the 'Shona does it again' thread and type out in your own words, mulronie's wording from post #27 there. Also include the points that won the decision posted in post #1 there which was against PE. USE IT!
Make sure your POPLA appeal is clear in that it points out that that PE do not have any possessory title, no proprietary interest in the car park (cite VCS -v- HMRC) and that you require PE to produce a copy of their contract with the owner/occupier as well. TWO SEPARATE POINTS. Say that if the owner/occupier has not assigned any legal title (a form of ownership) to PE then PE cannot allege contract or trespass against any visitors - as such, you require POPLA to cancel the fake PCN. And add in anything else you want to add such as PE ignoring and not responding to your original appeal points (and enclose copies of your receipts from that day's shopping).
POPLA need to know everything, your evidence should not be mitigation, it should be a long and detailed demolishing of PE's attempt at a claim.
What's your deadline to add more evidence? Do not ignore this when you are halfway to getting this fake PCN cancelled!
Finally, what did the main retail Store Manager (not McDonalds but wherever you did most shopping) say when you complained about this harassment just before Christmas - their busiest time! - by their abominable car park agent? You did complain? It is not too late and would be grand if they (try various shops on site but forget McDonalds who do not give a stuff about this scam) say they 'will get it cancelled' - you could take their name and include that promise in your evidence as well.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Well I keep all mine to show people - and you should do really just in case PE see your ignoring them as a green light to try a rare small claim. It is very rare though, normally it's just the DRP And Zenith letters shown in pics here, and yes you can just file them:

Why didn't you try POPLA and just get it cancelled, out of interest? I recommend POPLA in England/Wales - because we know wording that should get these cancelled. Thank you so much for your advice, I shall keep plugging with the appeal although you do start worrying! Will they take me to court for this in the end? Has anyone ever been to court for this and what are the chances of them taking it all the way!
