    The "punitive" judgement is at the discretion of the adjudicator in every case? Or is there guidance on that?

    Would a non punitive charge account for losses in rent/parking fees AND administration charges, postage, running cost of the system?

    Yes it's not binding on you, so ignore the request to pay the parking company. You can now expect to get series of demands to pay them. Unless they issue a small claim they and their agents should be completely ignored.

    NO you must not just pay. :eek:

    This is just a 'decision' based on an appeal by you. It is not binding on you.

    Please post what your appeal said in the end, and the POPLA decision in full as we need to see this is genuine. Sorry but you came to the party here so late and then 'lost at POPLA' despite the advice to add more points of appeal, which seems odd under tha circumstances...a dodgy decision by Shona then? We need to see it in a thread.

    Please start your own thread and post your appeal and the POPLA reply.

    Please edit out your reg number and ticket number etc, we don't need to see that, and there is a real risk that the parking company can see this and fancy taking you to the small claims

    And your appeal to popla was a waste of time as you basically admitted that you breached the terms, so such a soft appeal to them will always fail. You should have seeked and got help with the wording of an appeal to them.

    It would be likely that parking eye will take you to the small claims and you will need a much better defence there. I would advise taking the whole post down with the popla decision as parking eye employs people to scour this website

    You were told to get more advice from pepipoo.com, the appeal from what i saw on your post was that it was refused simply because you couldn't get out and went to McDonald's instead. I can only go on what you posted! You have provided far to much information on the thread and parking eye know exactly who you are.

    The popla decision is not binding on you at all, but because you have provided the information which is still showing on a post above from a month ago, it's likely that parking eye will issue a claim to try and embarrass the users here.

    If you decide not to pay and they go ahead with a claim, you will need a defence that will see them off, that will be from pepipoo as been mentioned already to you from coupon

    I did go to pepipoo and I used all the advise given to me. The reply I sent the was edited and submitted to them.

    Despite all my appeals I still feel there is one sore truthful pointvthatvsticks in my mind!

    I WAS back at my vehicle in time and I couldn't physically get out of the car park! The Christmas traffic was gridlocked I I couldn't get out! I know this is falling in deaf ears but it is so frustrating! I have followed the advice on this forum and I have now ended up with an increased fine, of which I am being advised to pay!

    Despite this charge being completely unfair I wish I have in a paid straight away and avoided all this stress. This may not be what many of you want to hear but this is how I feel and people should be aware it is a horrible journey that won't necessarily end up in your favour!

    Hold on. You have just been through the. POPLA court that puts the onus on you to prove your appeal is valid. As said to you by more than one person, you supplied too much information that gave them a let off.

    You can pay now if you really want, but your basic case is still a good one that should persuade a judge should it get to court. If it was me, I would let it Gert to court. My case would be that they are supposed to manage traffic and clearly do not. You were trapped in a car park and were obliged to go to the loo.

    You still have time to await the letter chain before deciding your course of action.
