    It always defaults to this Court, the correct Court will be added if it goes to Court.

    The story: Trying since September 2006 and ny word you do have to keep goiing with them. Don't give up people! I seriously thought I was going to be the first one going to court. But today they settled. Yippeee!!!!!!

    thanks again.. but im not too sure why or how you say this.... i had other debt with another bank they wanted £230 a month i couldnt afford it so we went to court and the judge ordered me to pay £10 as i had other debt to pay... so why is this any different? if i lose my home etc etc over the rent arrears and have a small child i know ths judge will take this into consideration, and to be honest this is if the bank arrive at court they might pay out like others..

    It is different because your claim in the small claims court will be about the unlawfulness of the bank charges and your right to reclaim them. This is what you will be stating in the particulars of claim and the judge will be ruling on this point.



    Put simply you can ask the judge to pay the money a certain way but he cant because the rules say he cant, the banks have priority. How the money is to paid when refunded is a seperate issue and already governed by the banks right to set off. To challenge this you need to do it a different way through the Financial Ombudsman either before or after the court process. I advise before and get any agreement on the matter in writing. It is just the way things work rightly or wrongly and again I advise you to go to your CAB for help in understanding how it works.

    Your claim at small claims court is about refunding bank charges. It will not be about how many debts you have and how they should be paid. That is a seperate issue altogether. I hope that is a bit clearer :)

    Hi there

    I wrote to the clydesdale bank in jan and and in the beginning of feb was asked for a tenner which I sent. I have still not recieved my statements and I have called them to be told that they are well behind schedule and I won't get them for at least another week. This is well over the 40 days. They have now refunded my tenner however what should I do. Sit and wait or start getting heavy ???

    any advice would be great and has anyone any success stories with the clydesdale ?

    I wrote to my bank (sent the letter to my branch) and they have replied to me stating that the charges are "fair, reasonable and transparent" and have stated that should I wish to take the matter further then I should write to the Customer Relations Unit providing them with a schedule of dates and charges (which I had originally sent to them!). What do I do now, is this just a delay tactic??

    Should I just start again but send the letter/schedule to the Customer Relations Unit?

    Hiya, I am just about to submit my MCOL form, but what happens if HSBC offer me the full amount (without intrest) in the next few days? Will i lose the £120 i have paid to MCOL?

  • I went overdrawn for ONE day as I mistakenly paid a credit card bill five days early. Have done what Martin suggests and phoned them up to politely ask if they can refund me the £25 they charged and with no arguing they are refunding it. Only £25 but hey, it's my money afterall.
