    thanks so much twinkly, i will go to the cab...

    but surly if it did go to court and i could show how much other serious debt i am in and that i have paid the £10 every month without missing one the judge would say i should pay the more serious debt?!?!?!

    I know what you're saying but it isnt that simple. The law has to be followed. It isnt for the judge to decide on your other debts. The judge deals with the matter of law before him in court which would be the refund of bank charges under a point of consumer law and nothing else. The way it is repaid is subject to the banks rights and unfortunately the bank do have the right to set off the refund against their own debt. Go to the CAB and challenge it with the bank using the information on the financial ombudsmans site before it gets to court.

    My second question is this - some people seem to be worried/scared at the prospect of taking a bank to court, especially with the OFT report due soon. I can't say I'm all that concerned but maybe I'm missing something. Am I right in thinking that the £120 Moneyclaim fee is the most that I stand to lose?

    They have so much to do that different responses does happen.. eithr way they are fobbing you off.. you are right to continue..

    The £120 is all you need to pay. Thats the idea of the small claims track.. If you were claimingmore and it went to an AQ at the court stage then there would be an additional fee.

    Charged me £650 over 6 years.
    I would accept £500 (no interest for prompt refund without court, etc.)

    Initial letter offering £68 (goodwill gesture) er, don't think so.

    Telephoned their 'executive office" yesterday cautioning them they were approaching their 14 day deadline and it would be advantageous (cheaper) for them to negotiate and settle directly with me as opposed to me suing them. Staff member dealing with my 'file' out of office.

    Said staff member called me as promised today - rather surly and unfriendly - but offered me £400. Goodwill gesture of £69 already been applied to my account.

    I said make it a TOTAL of £450 and it's a 'deal' - couldn't believe I was 'haggling'.

    They are raising a cheque as I closed the account.

    I personally don't want bother of filing court paperwork but it is tempting to do so and get the FULL amount (plus interest!).

    £1000 total recovered so far out of a total of £1450 of charges. Not bad. Next and last is my Halifax Current account - wish me luck!

  • I see on MCOL that Barclays put in a defence to my claim on the 15th March!! Does anyone know how long it will be before i hear when the court date is or when the questionairre will arrive?

    Hi all

    I have issued my Money Claim and wonder if the 5 days in which it takes to be served to Lloyds starts from the day that I ussued it? Iissued it on 19/03, so would the 5 days take it to 24/03, and then 14 days added onto this, being 07/04?

    just got notice of issue against lloyds but the county court they have giving me is northamton i live in durham can i get this changed??? thanks

    This is a quick note on progress to date and to inform people of a slight problem with Alliance and Leicesters address. I have put in a claim against A&L and had it rejected based on letters 2 and 3 (Martins letters that is) so I am now going to claim through the courts a total of £1,500.00 for the past two years!!!!

    One problem I had, that I am not sure if anyone else has, is that when sending letters to the customer service centre the Royal mail do not recognise the postcode of the customer centre (GIR 0AA). Therefore you cannot track your recorded delivery letters!!!!. They do appear to have got through though although for the third letter I had to call and check but I spoke to a very nice lady who said that she would re-send a letter they apparently sent to me rejecting my claim (which funny enough I have not recieved). So I just wnated to make people aware of that.

    So next stage for me once I recieve the letter from them is moneyclaim!!!!!!:p
