    Hi, Just download an N1 form and fill it in. Send it to your local SCC with the fee and they'll do the rest for you. They'll basically contact Natwest to see if they want to defend the claim and then it's just a case of wait and see. Good luck, I hope it goes your way!!

    Thanks for info- where do I find this N1 form?

    The story: Ended up entering the case at court, an acknowledgement was recived but no defence after 28 days, resulting in a win by default.

    Absolutely do not give up!! This is the standard letter most of us will have recieved, the aim of the letter to put you off and dent your hopes, which it seems they are amanging to do. Any charges, be it current account, credit card, catalgue etc. can be claimed back. And it doesnt stop with that letter trying to put you off. I have just won by default againt Littlewoods, I got the same letter saying their charges were lawful and they wouldnt be giving anything back. So I entered it on moneyclaim and they acknowledged the claim saying they would submit a defence (another tactic to put you off). They did not and after 28 days I won by default, and the judgment has been issued.

    Note that by enetering your claim on moneyclaim you are not requesting a court date, you are asking the court to legally issue the request for money. Only if they defend will it actaully go to a court hearing. They often do not defend, so you win by default, and the money is then legally yours. If they do decide to defend (an expensive process) then you will get a hearing date etc etc.

    Remember that this is all done at your own risk, and any advice is just that. It may end up in having to go to court, but consumeraction will give you all the support you need!

    Amount Received:£1500::D

    Accepted "full and final settlement" of £1500 the day after I issued County Court summons for £3444. They have acknowledged receipt of summons and have indicated they will dispute the full amount:eek:

    They did not supply details of charges they had made against the account despite my request in first letter!


    Have now issued paperwork to court and have received a reply in which presiding judge has written, "Excellent. Now let's see what the defence does"

    28/12/06 is the deadline for their defence to be filed. Now we wait!

    I have pasted below my blurb from the claim. Note my claim for the interest to be paid at the bottom.

    "The claimant has a contract with (add your institution)
    from (start date of account)
    (account no. *********) and which is conducted
    on their standard terms and conditions. (From here
    on add in the details of your own claim) The
    claimant is claiming the return of money
    taken by the defendant in the way of charges
    over the last 2 years. These charges are a
    disproportionate penalty and therefore
    unenforceable as they are contrary to common
    law. Further, as a disproportionate penalty
    they are invalid under the Unfair (Contracts)
    Terms Act 1977 s.4 and under the Unfair Terms
    in Consumer Contracts Regulations 1999.
    Para.8 and sch.2(1)(e). Administration
    charges other than penalty charges are
    unreasonable within the meaning of the Supply
    of Goods and Services Act 1982 s.15. The
    claim consists of such charges (penalties
    £10; admin. £5 and £15) levied to the account
    between 12.09.04 and 17.06.06 and a £10 Data
    Protection Act payment, totalling £250. The
    claimant claims interest under section 69 of
    the County Courts Act 1984 at the rate of 8%
    a year from 14.09.04 to 06.09.06 of £25.07."

    The legal bits shouldnt tampered with just add in your own details. Then when it comes to requesting a judgement, you have the option of adding on interest incurred since the court papers were issued. Hope this helps!

  • just keep getting formulas wrong, also theres more charges to add now too and when i add it it messes up. Amount is £4,165 since account opened Feb 13th 2004.

    Can i email someone my spreadsheet of charges and they do it, i dont mind donating cash to here when i win.
