Which should stick with its broomstick; and you should make sure you understand the actual t&c you sign up for. Sending the fourth bill was almost certainly too early - and the information they send with the phone is not as simple as implied, as anyone successfully researching cashback schemes would know.
As for a dealer going bust - that is always a risk and if it's the only deal and you can't afford to lose you must stick with a company which is highly unlikely to go bust. I'm afraid that means the one you're now complaining about. Whilst I regularly attack them nowadays it is plain you aren't aware of the relevant threads so have started yet another one. People who get stung because they didn't do the groundwork should stop trying to ban deals for people like me - who do. Sorry, but I have lots of these deals and (whilst suing them myself for the first time right now) I am quite confident of getting all my money just as I always have (apart from losing a little on a risker dealer who went bust but who I've never complained about - and even defended since).0 -
bassman; you may find this of value should the need arise. They have been busilly changing all the information and t&c on their website (I'm anticipating another problem now as a result on one of my older contracts but naturally copied the previous t&c at the time and a few times since so i can prove my case should this have happened - as it now has!). I came across this just now, hidden carefully away:-

"It is important to follow the steps to your make your claim correctly first time round and in the correct claim window, but if you do make a mistake then providing your claim period has not ended you are able to try again.
We recommend that you send your claims at the start of your claim period so that you have allowed yourself plenty of time to correct your claim should it be rejected."
It may help if needed (though I doubt I will be on this occasion) and backs up on of my earlier points (maybe two of them, in fact!). It seems cpw now prefer to play games rather than honestly. I'm up for it if needbe! First legal proceedings about to commence as a result. Lol!0 -
Mobilejunky, I appreciate the need to comply with T&C and did, as I stated in my initial posting. The T&C for my offer read "Send your 4th, 6th, 8th, 10th and 12th monthly bills within 30 days of the date stated on the relevant airtime bill, to us and we will credit you by cheque with £72.00 each time." I sent the fourth bill within the 30 days period, complying to the letter with all other T&C, and it is that first claim that I am waiting to have approved. Interestingly, although e2save is continuing to ignore requests for payment of the first cashback it has sent me a text to say that it has approved my second claim - made two months after the first claim and within 30 days of receipt of my sixth bill, whcih suggests that what you write about my claiming too soon is nonsense, as is also clear from the T&C. Whether I actually receive a cheque is yet to be seen.
I suggest that you do not accuse me of not reading and complying rigorously with T&C without knowing the facts or reading my posting properly. I made it quite plain that I have and am acting exactly in accordance with T&C of the offer. Also, I was quoting Which! on the cashback schemes promising much but failing to deliver. Furthermore, I warned users to be careful and did not call for them to be banned - Which! was the one that suggested avoiding such schemes.
Personally I used e2save as I thought that it was unlikely to go bust. I also thought that being linked to Carphone Warehouse it would be reputable and honour its commitments. Perhaps it will in due course but hat remains doubtful as I write.0 -
Sounds like the e2save price match t&C which I thought go on to define the 4th bill as the one you receive after you have been connected for 4 months. This actually differs from the standard e2save T&C for which the 4th bill is the 4th one you receive....I think....0

The deal that I had told me to ignore the standard terms and conditions and to follow those in the email sent to me. These t&c had odd little twists such as giving a different address to which to send the claim. That is why, as mobilejunkie noted, it is very important to pay particular attention to all clauses in the t&c as these can differ for particular deals. As far as I can see, I followed these rigorously. The fact that e2save has indicated that the second claim, which was made two months after the first claim and within 30 days of receipt of the sixth bill, has been approved makes it even stranger that they are yet to meet the first claim.
The failure to respond to emails or faxes by the person considering my claim is inexcusable.0 -
If you're sure you've met the legal t&c and can prove they received a proper claim, issue a LBA and if they don't respond sue. That's what I'm doing with one of mine where they've decided to end up paying out more than twice what it would have cost them in the first place. It appears their latest response to awkward questions is stick stick their heads in the sand - or somewhere else more appropriate.0

Could someone please help me on the following....
I am on the 2nd of 5 cashback claims for my contract. However e2save have rejected my claim as they say they didn't recieve any voucher with my bill. I am certain that I sent the voucher. After recieving the initial rejection letter, I resent the bill with another voucher but this was rejected also, with the same rejection letter I recieved previously. Now I am not not sure how to proceed. I've emailed them but I was told "our cash back claims are carefully opened by individual advisors who ensure that they clarify exactly what has been received along with a cash back claim", and they are insistent that no voucher was sent. I emailed them back insisting that I did send the voucher and resent another voucher after the initial rejection. But I am recieving the same generic response, basically saying there is nothing we can do. I even told them I would be seeking legal advice but still the same response.
I stand to lose over £300 as they say since it was a pricematch deal, I will be unable to claim any other cashbacks.
So what can I do know? If I decide sue them how exactly do I prove that the voucher was sent to them?0 -
A new one from them. A warning to the rest of us to copy everything we send carefully.
Rule 1:- Always staple the voucher to the bill.
Rule 2:- "I am certain" is not good enough. "I did" is the only thing you should be saying.
If you have legal expenses cover on your home insurance you can see if they can take this up for you - or at least offer advice. It seems to me that it would be up to you to convince a judge that (on the balance of probabilities on their side on yours) the voucher was included. The voucher is tiny so it's quite possible it fell out of the envelope when they opened it. Whether a judge will believe you is unknown. The resend shouldn't have produced the SAME response so might help your argument - especially IF you got it to them withing one calendar month of the correct bill (regardless of whatever timescale THEY are quoting).0 -

I would guess that the missing voucher issue could come under unfair terms and conditions. It gives the other party an unfair advantage over you.0 -
