    I am NOT a mortgage & insurance adviser - or anything to do with finance, that was put on by the new system I dont know why?!

    You pay for the issue of the summons, then if necessary for the hearing. If you win all court fees paid are added on to the amount you claimed to be paid by the defendant.

    The fees are on a sliding scale depending how much you claim. Minimum is £25 to issue a summons and a further minimum £25 if a hearing is needed. These cover a claim up to £300.
  • Make sure you send them a "LETTER BEFORE ACTION" (LBA) first - this gives them the opportunity to pay up.

    A judge will not take kindly to you not doing this first.

    This shows you have tried to get your money and given them chance to pay up before going to Court.

    BTW they have NEVER replied to ANY of my LBA but you have to do this first.

    This is my 1st post, so please bear with me
    A few weeks ago i treated myself to a contract phone from One Stop Phone Shop. It came with a free laptop. It was delivered the following day (t-mobile network) and everything was great.
    Last Thursday i decided to treat my other half to a contract phone for xmas from the same online shop (OSPS) his came with a free ps3. .
    I hadnt received an email confirming delivery by the following day and order status was saying 'back order' so i decided to give them a ring.
    The guy i spoke to was very helpful and said he would locate the stock himself for me and get it sent out that day.
    They dont deliver Saturdays so i received delivery yesterday morning. Everything was present and correct
    I put the sim into the phone and tried ringing out....everything ok. I then tried to send a message and it kept saying 'barred'. I checked the message centre number and all settings and everything is ok
    I rang t-mobile and gave the number of the new phone. They informed me it doesnt exist. The lady then asked me to give her the serial number off the sim card. I did this to be told that there is no record of this sim and that there isnt even a profile set up for it.
    She told me that t-mobile had not passed a second contract for me as they are now tightening up on this for new customers. You have to have a few months good payment history with them now before they will pass a 2nd contract
    I informed her that i can call out on the sim but not text. She didnt have a clue what had happened and said 'all i can tell you is that we havent given you a 2nd contract'
    She said the only thing she can do is tell me to get back in touch with OSPS. I have tried contacting them but cant get through.

    The strange thing is that all the paperwork states i passed the network connection set up on this 2nd contract and it states that my dd has been set up. But t-mobile say they have none of this info and only have dd set up for my initial contract
    I even have emails stating that my network application and order has been succesful.

    Does any1 have any advice on what my next move should be? I am so annoyed as this is a xmas present. But t-mobile are not budging on giving a 2nd contract and i cant get a response from OSPS.
    It states on the sim envelope that once the sim has been inserted in the phone and used then this is an acceptance of the T&Cs and i cannot send the handset back or cancel the airtime contract.
    Doesnt this work both ways? I want the contract and have fulfilled my part by placing sim in phone and using it to accept contract. So can they back out now and not give me the contract?

    Any advice would be greatfully received. I dont want to send the phone or ps3 back and am willing to stand by my side of the contract and keep the contract phone.

  • Wait and see if the dd for the second phone actually goes out. Since T-Mobile say the contract isn't set up, it shouldn't. If it does go out T-Mobile will have to put it right. Either way you still have the freebie. I'd keep stum for now with E2Save - they DO make mistakes in your favour sometimes and it's best NOT advertised!!

    Seems to me you're in a great position - don't spoil it by making waves until you know if you will actually end up paying ANYTHING!

    By the way; T-mobile cleared me for 5 contracts when I got my first one, so what they told you is either not entirely true or they have changed things a lot. Each applicant gets cleared for a certain number of contracts wihtout further checks - Vodafone is the same.

    I have just rang t-mobile again (before reading your reply). The woman stated that one of their employees had put a not onto the computer after talking to me yesterday stating '2nd contract not offered, return goods to carphone warehouse'

    Her advice today was to ring OSPS and ask them to ring t-mobile to set me up a new account. I asked if she couldnt just do that from her end and she said no, OSPS would have to call them and sort it

    i feel in limbo now. Yes i could keep quiet and not say anything, but what if OSPS contacts me and demands me to send the phone and ps3 back? Do i have a leg to stand on? I dont want to give it as a xmas pressie to then have to take it back and send back to OSPS

    I am so annoyed about this. Like i said to the woman at t-mobile, surely the contract is a 2 way thing. Iv accepted by using the sim, surely they have accepted by sending the stuff out and sending emails saying i have passed the network application etc
  • My money would be on OSPS forgetting about it. They are utterly incompetent. If they did contact you there's still the option of getting them to restart the contract. Although the present part is unfortunate thus far it's cost you zilch and there will probably be other offers if you are asked to return it. Only you can decide that!

    Well, credit where it is due, I forwarded my details to the above and they responded quite quickly and my final cheque has arrived today.

    My thanks to 'e2cs' / 'forumsupport' for resolving my dispute, however, my case would never have developed into the fiasco it did had e2save not 'tried it on' and conspired to steal my final £84.

    That's it though, no more e2save for me and I've terminated my TalkTalk contract in protest too.

    Reflecting on my experiance, I wonder how much commission CPW pay their 0870 tele support people to lie as they do?
