  • As for my new contract, i now have a better way of doing it. No cashback hassle at all, i looked on onestopphoneshops website found the deal i wanted,

    which was the new SE 8mega pixel one on clearance
    18month contract 600min Unlim text £35 a month
    with cashback it worked out at £21.72 a month

    so i called up my current provider orange, and basically said, this is what i want, if you can better the deal i'll renew my contract.

    and they've sent me a brand new SE 8mega pixel camera phone, on £20 a month

    Has anyone's county court claim made any progress? They have managed to get my claim delayed until next year. :mad:

In the end the only way i got my final ca[/SIZE][SIZE=-1]shback[/SIZE][SIZE=-1]s wa[/SIZE][SIZE=-1]s by contacting OFCOM and getting my [/SIZE][SIZE=-1]solicitor to [/SIZE][SIZE=-1]send them a litigation proceeding[/SIZE][SIZE=-1]s letter.     I wouldn't take much notice; though believe it or not I still get attacked for warning people away from this company, as I have now been doing for about 18 months. To think, before that on at least two occassions I was accused of working for them by people on here because I used to defend them. Those days are long gone - I give fair feedback and warnings and none deserve the warnings more than this bunch of liars and cheats. It is at least satisfying to see more and more ex-loyal customers realise publicily that they have become what they now plainly are - and that the large number of people commencing legal procedings to get their just claims must be costing them a fortune in solicitors' fees. It is also satisfying to note that their share price continues to plumb new lows, rivalling the banks for wiping out shareholders' funds at the greatest pace. Any orgaisation with half a brain would have learnt months ago that this is a road to disaster (even this incompetent government won't bale a retailer out!), but obviously no-one at cpw HAS a brain!

    Well to provide you with an update on my claim and my mum's- they are both to be heard tomorrow morning.

    I won't divulge what I expect to say in court in response to their defence considering that they monitor the thread albeit their defence concerns the fact they admit that a number of seperate computer errors at different times unbeknown to them caused the claim not to be paid. However by offering to meet the claim to date after the MCOL was served is sufficient to show that I have not lost out.

    Their defence consisted of 28 pages from their systems and one of their reliable staff!

    Shame about their computer. Expect it's one they give away with their phones along with the truth! You have lost out simply by not being paid WHEN you were supposed to, plus the additional cost you have incurred. I also expect the "errors" didn't come to light with your initial LBA, but only when you actually sued (would be worth pointing out in court!).

    As for the Director's resignation - whilst it shows up the people in charge for who they are it won't impact on cashback contracts directly. It must impact on their share price, however - which has already been knocked for several sixs in the last few months. Don't rush for the hankerchieves!

    You are the first ever to post that a MCOL has reached a hearing.

    Previously they have submitted nonsensical defences which weren't addressing the claim, (which were really stalling tactics whilst they hoped their out of court offers to settle (for less than the total claimed) were taken up). When push came to shove they have paid up. If your case is that they have committed a fundamental breach, have they defended this specifically?

    Be sure you have submitted your claim properly, and provided both them and the court with copies of the contract (if you are claiming it has been breached).

    If you lose, they will be entitled to all their travel costs, witness costs, as well as loss of earnings for attending, on top of you having to pay the court costs.

    I know of another which went to court. Methinks they are attempting to apply more pressure to honest claimants who are forced to sue in order to get their money. It will cost them a lot in legal fees which they can't recover even if they do win now and then; but it is important to ensure your case is sound before embarking on the legal route. Provided it is, it wouldn't put me off suing in a moment!
