even if act one was authorised act two wasn't
e.g. there was a case where police officers were prosecuated using the act because although they were authorised to log on and use their systems they were not authorised to do searches etc outside of their job role.

I know it's an old thread but I wanted to join in!
Hotmail don't keep a backup of anyone's deleted emails on their server so in this case it would be difficult for him to prove that the emails actually existed.
It's obvious that she's broken the Computer Misuse Act, but he'd find it impossible to prove the emails were there in the first place, never mind that she deleted them.
If she had (as others suggested they would) sent the emails to everyone he knew, then it would be much easier to prosecute her as the email address she sent them from can tell Hotmail where the account was created - if they were created at her address, it would be difficult for her to prove she hadn't sent them, and so that she had gone onto his email address without authorisation.
I think it's a gross invasion of privacy, myself. If someone doesn't want to be with you, walk away with your head held high, don't go reading things that are nothing to do with you.0 -

I somehow doubt that he will have the balls to walk into a police station and admit to somebody on the duty desks that he'd been caught with his trousers unzipped and a female has got the better of him . When he calms down he'll realise that he will have made himself a complete laughing stock. Male pride and all that .........!0
