The ombudsman won't deal with legalese claims for bank charges.
Nothing to stop you starting a new claim ultimately ending in court though if you think you have the law on your side. Hi there, be gentle as I am a first time user.
Whilst I appreciate that there is still a couple of options available to us for reclaiming bank charges my argument is how have banks selected such customers. Is it not unfair that they have chose to make paymnets to customers who have the same terms and conditions as all of us. Why should it be up to the bank to be selective on who they make payments to.
My case has been on hold since 2007, since then the bank lost the test case and also the appeal in the High Court. Should it not be that customers who had cases on hold prior to the decision in the Supreme Court get paid out. The banks have been and still are making payments to customers who I would imagine have got the exact same account history as me. What is the banks method of selection, is it postcode, is it because a customer might have savings with that bank, are they ignoring my claim due to the fact that I closed my account.
The process for selection must be unfair and unacceptable and should be challenged.
I would be interested in your views on this approach.0 -
I had a mortgage with the royal bank of scotland which ended 3 years ago and I also had payment protection on the mortgage. When I remortgaged to Alliance & Leicester the Royal Bank continued to take my payment protection out for 3 years, am I entitled to this back0

People are not selected to have their fees refunded.
Currently there are essentially two reasons why banks are refunding charges.
1. A customer complains about an odd charge, the customer hasn't incurred charges before and has held the account in good standing, and the bank agrees to make a good-will gesture credit.
2. A customer has incurred bank charges and claims they are in financial hardship, which they go on to prove. Each claim is assessed individually band an appropriate 'positive and sympathetic' approach to help the customer is put forward. That may, depnding on the individual circumstances, involve a refund of some sort.

ive got an account with nationwide, which im currently paying of. they partially reversed a charge for us in 2006, and sent us a letter asking us the sign and accept the t & c's for the account, and if we didnt respond in 14 days they would close the account. We didnt sign the form. But they never closed the account, and continued to apply charges. i then contacted them with a repayment offer which they rejected, and forced me to pay more, and then defaulted the account anyway. because they gave us a partial refund, can i make a claim for the extra charges they applied when they didnt close the account?0

You could try, but I wouldn't hold out much chance of success.
If you wish to avoid charges, pay off the existing debt and close the account yourself. They won't usually close an account whilst there is an existing debt on it ... but they may suspend it to prevent you using it (other than to pay in money); the original debt still remains and accrues charges until repaid."Now to trolling as a concept. ....
