i got this account since 2005 october. ...
Have you read and digested the guide to reclaiming bank charges referred to in the initial post of this thread?
Are you in financial hardship? If not, the reality is that you'll be most unlikely to succeed in getting any charges refunded.
Even if you are in financial hardship, there is no obligation on the bank to refund you any charges.
It would certainly be worth you arranging to speak with your bank so that you can hopefully understand why you are being charged the fees you are, how you can try to avoid them in future, and perhaps most importantly how to avoid the embarrassment and inconvenience of having so many transactions denied by your bank."Now to trolling as a concept. .... Personally, I've always found it a little sad that people choose to spend such a large proportion of their lives in this way but they do, and we have to deal with it." - MSE Forum Manager 6th July 20100 -
As I understand it, one item taking the account over £100 into an unplanned o/d would result in £20 per day charges plus a £15 per month charge (total £55 for 2 days).
This will change from December where the total charge would be £25 for a similar occurence (being made up of 2x£10 daily charges plus £5 monthly fee)
That's why, if I ever do go OD I have a good OD in place so I *don't* get hammered for charges.
That's quite generous if your last statement *does* apply to Lloyds for unauthorised ODs. I thought they wanted to make money off us...0 -

Unfortunately, the downside is that even with a planned overdraft, you will get hammered £5 per month (plus the usual interest) if you use the facility after the tariff changes in December.
(there's a £10 buffer before charges are applied)"Now to trolling as a concept. .... Personally, I've always found it a little sad that people choose to spend such a large proportion of their lives in this way but they do, and we have to deal with it." - MSE Forum Manager 6th July 20100 -

Read the MSE guide about attempting to reclaim bank charges which explains exactly what to do.
If you are not in financial hardship, there's little chance of getting any refund ... and even if you are in financial hardship, there's no guarantee you'll see any refund of charges.
Don't go to any other company in the hope you might succeed where you fail - they'll only follow the above guide (if they can be bothered) and will charge you if successful following that route."Now to trolling as a concept. .... Hi
I attempted to re claim charges and sent all relevant paperwork to HSBC and was then sent a letter stating that my claim was on hold whilst they awaited the court ruling. I was then sent a further letter after the ruling which stated that they were no longer obliged to repay my charges.
In order to recommence my claim would i need to start the process again or can i now go direct to the ombudsman and can i request my paperwork back from HSBC or apply for my transactions again?0 -

You could just start a new claim. It probably won't make much difference as no one has won any refund based on the legal arguments put forward here since the banks won their victory in the Supreme Court last November.
The FOS will not entertain any legalese claims for bank charges; they will only condiser claims for those in genuine financial hardship (and if that applied to you, then you shouldn't have allowed the claim to have been put on hold - there were waivers in place for those who were in financial hardship)"Now to trolling as a concept. .... I would suggest you take a look at the sticky about financial hardship online resources for an explanation of what is considered financial hardship.

Hi.
I am new to the forum & apologise if I am posting my query in the wrong place. I have a quick query on reclaims under the financial hardship guidelines. I am trying to reclaim a couple of grand in charges (over 2 Halifax accounts) on behalf of my mother who is very sick and meets the hardship criteria on many levels. The claim was originally made prior to the courtcase and the Halifax fobbed her off in January. She took it no further due to ongoing problems and I have reinstated the claim, including the second bank account. Because my mother has shut the main bank account in the meantime, to prevent any more charges, the Halifax are now refusing to deal with this part of the claim (surprise surprise, this is the bank account with the bulk of the charges!). Are they able to do this? Should I pass the matter to the FOS? I was under the impression that the only limitation on claiming was re timescale (ie 6 years max).
Thanks in advance.0
