    I starting my claim in June 2007 from the Halifax for £1,200, since then through a lot of hard work and struggle my financial situation has improved. Can I still continue with a claim on the grounds of financial hardship??

  • Wangtao Financial Hardship is when your outgoings of the bank charges are more than you have incoming, where you can't buy food, rent, council tax.

    i would still send a letter and see what there response is but dont get your hopes up

    If you were in financial hardship, you should have disclosed this at the time of the claim (or whenever you started to suffer financial hardship). There was a waiver in place when most claims were being stayed that allowed claims to continue to be heard when involving financial hardship.

    You may have now missed the boat. If you are no longer in financial hardship, then refunding of any charges now won't help the previous situation.

    I dont think I can claim back for a now monthly £5 charge from A&L as Im not always depositing £500+ a month into the Premier Current Account. I want to avoid this charge.

    Im guessing I can transfer back and forth £500 to my A&L online saving account to avoid this charge?

    Are there any current accounts either at A&L or elsewhere that dont charge if you dont make a consistent monthly deposit?

    I doubt if moving money from a linked savings account would count

    Most current accounts at most banks do not have a minimum deposit requirement. I'm pretty sure A&L do - or did - one before they became Santander, but otherwise the whole High Street is yours.

    yeah, thats why I asked about the moving from savings to current

    ok, I think a change of bank is worth investigating then thanks

    I contacted my bank (Halifax) in July 2007 regarding unfair bank charges. They replied in August and with a copy of charges totalling £447.00 detailed in their letter about the legal proceedings between banks & the OFT. So I waited patiently...very patiently. Then wrote to them again after the OFT decision (using letter on here as a guide) in July 2008. They replied August 2008 saying that my case was still in hold. Since then I have heard nothing....! What do I do now? I know its not a lot of money but wanted to see this through.

    Any advice much appreciated

    Hi would like abit of help, I wrote to LLoyds two week ago about charges totalling £320 which I have had since october last year due to illness and recovery, I stated about this and that I wanted refunding but they have refused. I think this is wrong as what as been happening to me would anyone advise to take to ombudsman now????

    The final result of the legal argument between the OFT and the banks was widely publicised not just on this site but in the media in general almost 9 months ago.

    The letter you received from the bank should have advised you of the options available to you.

    Unless it was a deadlock letter, (or otherwise their final response) it may not have invited you to take the matter to the ombudsman. Unless it was a deadlock letter, the ombudsman will not consider your claim until you have allowed the bank at least 8 weeks to come to a resolution.
