  • Hi,

    I do not get this whole blog thing!!! So i am really grabbing at straws. But I am redoing the letters to reclaim as i talk to you. However, i do not know any of my old bank account details. they have all been sent to debt collectors. yes i owe large amounts of money, and will have to go bankcrupt, but tryinat least to get some back that they took. how, what ,do i do about the account numbers

    Thanks for your reply. :) I read that several people are threatening to take their banks to court based on Martin's new arguments. Has no one followed through with this?

    Some have tried, but no one appears to have succeeded to date.

    I think you will be unlucky I had a similar problem with A&L last year just at the time they were telling everyone how they were now part of the big company Santander I had a D/D due out but was away at the time having been told how great it was they now were part of Santander the area I was in had no A&L so went to the ABBEY to pay in the cash NO WAY would not take it.

    When I returned home I found that the £5 per day was now up to £56 and was told it would continue to rise until paid. I have now voted with my feet and found a proper bank instead of an ex Building society who pretend to be a Bank.

    Hi all

    I am about to start my re-claim on grounds of hardship, but not sure who to send the letter to. I was with the Abbey National, but of course they are now Santander...any ideas please.

    Unless you are experiencing current financial hardship and the hardship is household ie it affects everyone then the likelihood of success is almost zero. Furthermore, no bank has to refund even 1p under financial hardship.

    Hi, just wondered if anyone can advise me on what to do next. I contacted Halifax over a year ago about the large number of bank charges applied to my account, they responded and told me they will wait for the court ruling on this and will contact me to settle the claim after this.

    I had no response so contacted them recently as the charges on my account in the past 2 years totalled around £1300. I went down the hardship route as most of these charges were applied in a 2 month period 2 years ago when I was in hardship. In response they told me I cannot claim back any charges due to the court ruling but as I mentioned I am in hardship fill out the financial hardship forms, however I am not in financial hardship now which I stated in my original letter so there is little point filling out the forms. Should I contact Halifax again or should I take this claim straight to the ombudsman, also after not responding to their letter they have sent me the financial hardship forms 3 times in the past 3 weeks.

    Would be grateful for any advise on this

    There was no reason for your claim under financial hardship to have been delayed ... there was an exemption at the time to claims under financial hardship, details of which was included in the MSE article at the time.

    As you are no longer in financial hardship, what benefit would it have on your historical financial hardship by refunding you any charges now (albeit there's no obligation to refund any charges anyway based on financial hardship)?

    Talk to the bank to see what would be the best solution to repaying the money you owe them. Borrowing long term on an overdraft is not usually the best solution.

    Hi hope you're all well! It's been a while since i've been on here.The last time was to report my PPI success from black horse.But i've had a bank charges cae on hold at Halifax,but ever since i heard of the wrongful success of the crooked banks back in Nov09,i've felt very low as to whether i'd ever get any money back?

    But i still feel i've got a very strong case for getting my money back but not sure if i can now do it?
    In jan 2010 i received a letter from halifax stated that the courts had ruled in their favor. They gave me eight weeks in which to reply or they would shut the case on my reclaim.
    Having heard the ruling i thought i would never get my money back so i did not respond to the letter i now the eight weeks is up.
    I still feel i have a very good case with good evidence & want to write a letter to the ombudsmen. So my question is,would i still be able to write to the ombudsmen about my case even though halifax have said they will close the case?
    I'm writing this quickly at work so if i've missed anything can you please let me know?
