After getting my finger out to put claims in for PPI I was looking through my mother's paperwork to see if she had any PPI. Thankfully she didn't.

However I discovered she was charged £320 for 10 items Abbey Nation paid putting her over her overdraft. £20 for going over the limit then £30 for each item.

This was July 2006 when my Mother was being diagnosed with terminal cancer.

Prior to this she had not been overdrawn or over her limit.

Can I put in a claim?

Hi! I'm new here and am writing firstly to give some info which may help other people in the first steps of reclaiming bank charges and secondly for some help:

    1) After reading the guide on reclaiming bank charges I logged in to my Barclays account to try and access all previous bank charges from when I opened the account five years ago...no success. I then rung Barclays and I am now being sent a full list of all bank charges since my account was opened up until the present day totally free of charge, so if anybody is worried about trying to gain this information if they no longer have their old statements, don't be! (Although I don't know if other banks will oblige like Barclays have) Hurrah!

    2) Most of the charges I incurred happened whilst as a student nurse living in central London (650 bursary, 400 rent, 250 left for food, travel, books, clothes, toiletries, etc etc) and so I accumulated loads of charges...how many exactly I should find out in roughly 5-7 working days according to the Barclays woman on the phone. My question is whether I can realistically claim these back as financial hardship and it's impact on my life... As a result I opened another account and now have a £1000 overdraft as well as living permanently in my £400 Barclays account overdraft.

Any help would be very much appreciated!

    Many thanks,

    Chloe

    Hi

Did you phone your local barclays branch or was it a head office? I used to bank with barclays and incurred 100's of bank charges over the past 8 years and as a result had to go into a dmp as a result. How many years worth of transactions did barclays provide for you?

    thanks

You should put your claim in writing to the address given in their complaints procedure.

However, under financial hardship banks typically only refund about the last 6 months charges at most (and may waive some for a few more months going forward)
Each case is assessed on it's own merits and there is no guarantee the bank will refund or waive any charges as they are under no obligation to do so.

Another important factor is the charges are only usually refunded/waived on the customer's main bank account (i.e. the one they receive their main income into and use on a day to day basis). You say you used to bank with barclays, so I would think any claim would fail on this basis.

I finally obtained a Subject Access Request yesterday, 63 days after applying and 54 days after Santander had cashed my £10 cheque. The Information Commissioner say they should supply it within 40 days but as far as I know, they are not penalised for missing the deadline. I had to chase them all the way for it.

What I found was truly shocking. In 2010 my employer decided to stop paying me, the money going into my current account obviously was patchy and I slipped a whole 80 pence over my overdraft limit. I noticed within a week and managed to put £100 into the account - no matter, within a month £100 had been added in charges, pushing me back over the limit. I paid some more money in, same thing happened, then again... each time I topped up to get me under the limit, charges pushed me back over.

In just 8 months, when I was able to finally pay it all back, the bill for Bank Charges was over £700, for which I am seeking every penny back - I feel as if I have been mugged. I simply cannot believe they did this to me. Charges on charges, punitive fees. The first response I got from them was a brush-off of course. I have written a clear letter explaining what they did and about my circumstances.

I have vowed never to go near Santander ever again.

Why did your employer decide to stop paying you?

How did you manage to accumulate £100 worth of charges in just 7 days?

Are you sure you were only overdrawn by 80p? As I believe Santander offer a fair fees policy where they do not apply fees for being up to £12 overdrawn.
(not sure when this was introduced though)

Not strictly my employer - it's complicated, but basically they ripped me and others off. We had a legal agreement and we could have sued them, but they would have liquidated and run off before we could have reclaimed a penny.

As for the charges, I've uploaded a statement. I'm looking at the period starting from 06/06/11 where the charges just snowball dramatically.

My overdraft limit was £850. Yes, I should have looked more closely, but then I had a few more things to worry about at the time. Santander kicked me whist I was down.

My father died 22/1/2011 so helped my elderly mother with utilities etc then looked at her Barclays account.Dad was 89,Mum was 82 at the time.Around Feb.2012 got mum to change to fee free account and wrote to claim for refund of fees. They had the account upgraded YEARS ago @ £5/month which was 'up-dated' periodically to £13ish which mum wasn't aware of a/the fee or b/the benefits.
After corresponding for some time they used the 'we have written to you every time the fees/benefits changed' excuse and offered a goodwill payment of £50 but would not budge further.
Obviously Mum was still grieving and with the financial upheaval of my Father,s death decided to accept their offer. She was also worried that her 'friends' at the Bank would be unhappy with her claim(!) and that they may close her account(!)
    So she accepted the offer.
My question is --Can she claim retrospectively remembering that she doesn,t actually know how long she has had this account and she has already accepted a sum?

You should read todays email from MSE. In particular the item on packaged account charges. And then, if you still have a question, post it in the thread linked to in that particular article.

This sticky thread is for discussing the article linked to in the OP :)
(Reclaiming bank charges relating tor busting your OD and/or unpaid item charges)

Edit: or post in the thread you created on this matter almost 2 years ago when you first joined MSE

Not sure if this belongs to the correct thread or not, but I'm sure someone will point me in the right direction - I hope.

My fiance banks with Natwest and he was sold an Advantage Gold account with them many years ago and was basically sold it so that he would then gain a preferential interest rate on a loan he was taking out with them, is this mis-selling?
  • Morning all.
Just signed up for this forum.
I am currently putting together a case for reclaiming overdraft and returned item charges.
I was wondering if it is possible to include the interest charged by the bank on the overdraft as part of the claim?
    Any advice greatfully received.
    Thanks for your help.
