    You can include charges for as long back as you want.
    But the bank won't refund them.

    I know it must be a pain to repeat yourselves over and over to the new people, but i just wanted a quick yes or no as to whether i should apply for a refund......i believe i am in financial hardship. we have been using a payday loan company just to pay the rent and after paying that each month on top of bank charges we literally have no money left. We are in arrears with utilities and council tax (at least £300 each) and are in this awful cycle. we are barely able to eat and get to work each day. I feel like such an idiot and cry all the time because of this. I was homeless when i was 16 (6 years ago) and although i was on benefits, i didnt want that to be my life forever, so i got myself through school and went to university, but because of my past, i accumulated debts along the way and now find myself and my partner in this position. I know its my fault and i should have been so much more careful, we really need assistance in getting out of this hole and on an even keel at last. I have told the bank and asked if anything can be done and they have said no because i had 2 charges (£35 each) refunded when i was 17/18.
    I have spent today going through all my charges and they amount to £3000 in the last 3 years, pretty much charging me every month for the past 3 years :(

    In november i sent my complaint to Lloyds TSB regarding my financial hardship and asking for my charges back. I sent it recorded delivery and recieved notification that my complaint had been recieved by them. After 14 days i contacted Lloyds as i had heard nothing from them. the advisor said they hadnt received my complaint. I told the advisor that i sent it recorded delivery and had proof. He asked what my complaint was about and i gave him an outline of what my letter stated. I complained to the advisor that i wasnt happy that my complaint wasnt dealt with in the appropriate timescale. He came back to me on the phone and told me they DID RECIEVE my complaint and would not be refunding any charges. A week later £50 appeared in my account and a letter in the post with Lloyds acknowledging that they as they as didnt respond in the correct time they gave me £50. After looking at my final response letter i realised they hadnt ackowledged anything i had written in my letter. This week i called lloyds tsb asking for my complaint letter back including all the statements i had sent as i wanted to forward my complaint to the ombudsman, only to be advised that my original complaint was the telephone call i made on the 30th of november (the call to check the status of my complaint) and they have recieved no letter from myself. Im really angry that Lloyds have not taken me seriously, and that that they havent looked into the issue that i sent personal data in the post to them and have proof that they have recieved it, so it seems they have lost the info i sent to them. this concerns me.

    I would like advice as to whether i should resend my complaint, along with another complaint letter stating how i have been treated regarding this, or just go straight to the ombudsman?

    any advice would be greatly appreciated. thanks :)

    If you have not received an acceptable resolution from the bank within 8 weeks of making a complaint, you are entitled to ask the FOS for assistance.

    The bank are not obliged to return your letter of complaint. Hopefully you kept a copy as a proof of delivery/receipt is no use unless you can prove what was sent.

    Today I completed a letter to Halifax asking for £995 worth of bank charges to be refunded. I am in financial hardship and am in the process of filing for Sequestration ( Scottish equivelant of Bankruptcy) . Does anyone know if there's any chance they might look at my circumstances favourably?

    Send your letter off and be optimistic. Don't forget to send it by recorded post and keep a copy.

    Can't comment re. likelihood of refund I'm afraid but things sound pretty bad for you and, if the bank don't find irresponsible spending against your account, there is always a chance.

    Well they might. But what difference does it make? Unless the law in Scotland is dramatically different won't the £995 go straight into the hands of the Scottish equivalent of the OR? Or am I missing something?
  • Hi, provided my evidence for reclaiming Natwest bank charges since 2011. I've basically been unemployed, unable to get full time employment, on and off JSA, and always in the bottom of my overdraft, having to live back at my parents... and yet they have said the charges are justified... :doh:
    If I'm not justified as under hardship, I don't know who is. :think:

    The main crux of it was this:

    " In light of the contents of this letter, we do not accept that this argument could give rise to a finding that our unarranged overdraft charges are or were unfair or otherwise unlawful. We are satisfied that the charges you seek to reclaim were properly charged and the judgement of the Supreme Court on 25th of November 2009 confirms our position. We are therefore not upholding your complaint and will not be refunding the unarranged overdraft charges to which you refer. "

    Any ideas of next steps??
