    Called LTSB today to be told that was there offer - and it was final!. Going to write to the CEO and the Ombudsman now. Not happy with an offer of just over 8% of the requested amount, how is this supposed to help me get out of hardship?
  • In dispute with Santander at the moment over an old abbey national account. They first of all withdrew my overdraft without notice and then charged my sometime three times per day for failed direct debits. After six years they sent it to a collection agency who chased for payment even though they did not have any details of the debt they were chasing.

    I sent a complaint off which they replied to with two different letters to my current and old address (Breach of Data Protection) wherethe responses bore no relation to each other or my complaint. They then ignored my second letter. I have now esclataed again in the hopethat I can get resolution otherwise its off to the FSO.

    I have also strengthened my claim by disputing there actions by breaching the following:-

    Regulation 5 of the Unfair Terms in Consumer Contracts Regulations (UTCCR)
    5. – (1) A contractual term which has not been individually negotiated shall be regarded as unfair if, contrary to the requirement of good faith, it causes a significant imbalance in the parties' rights and obligations arising under the contract, to the detriment of the consumer.

    I am hoping that this with the fact they they didnt respond, responded incorrectly to the wrong address forces them to resolve in my favour. Otherwise its an email to the executive office and to the FSO

    Hi all, after reading all your comments I have now decided enough is enough and I am about to start the process of reclaiming my bank charges. I lost my job in 2009 and my husband was also made redundant around the same time, since then we have incurred a whopping £2067 worth of charges and are currently experiencing servere financial hardship. My husband is currently self employed and in receipt of tax credits and I am still unemployed and do not receive any benefit whatsoever. We also receive housing benefit which has been eaten up by bank charges on a monthly basis which has forced us to borrow money off family and friends to make ends meet. As I write this the temperature in my house is currently at 13 as we cannot afford to pay for fuel costs. I will get my money back! I will also keep you posted on my progress. Good luck to all in your pursuit for fair banking. xx

    If it's been over six years, I believe you can call the charges dead. If you haven't paid them anything in the interim, you can just tell them there's no record of it, it's beyond the six-year limit and "go away".

    Check that, but I think it's right.
  • Hi, I phoned Royal bank of Scotland in September 2011. I basically told them I felt that I was missold PPI but I could not recall loan details. Luckily I have been with RBS over 20 years and although we have frequently re-financed from one loan to another it has always been with RBS. They phoned back within the week to give me details of the elleven loans that I had with them over the years. They sent me their reclaim forms which were sent back very quickly. In November they offered me a total of £21,000 of which I have so far received half. Thank you RBS for all your help over the years. Good luck to those of you who are planning to claim your missold PPIs.:j

    I would just like to thank you all for giving me the confidence to reclaim my PPIs.
    I phoned my bank RBS in July 2011 and asked for details of to reclaim PPIs. The bank was extremely helpful, as I told them that even though I had been with the.m for over 25 years and had loans with them for most of that time, I did not have actual details of any of the loans. They told me they would call me back in due course once they had looked into it.
    Two days later they called and gave me a list of eleven loan references, they also sent me the paperwork for reclaiming the PPI on them of which I immediately filled in and returned.
    In October 2011 I received an offer of £21000 which I gladly accepted.
    I would just like to say to everyone who was missold PPI, read Martins articles, everything you need is in there.
    Thanks for everything you have helped me with over the years, I have learned so much through this site.

    Sent three letters to LLoyds ,replies came from their solicitors refusing to pay the bank charges.Sent letter showing financial difficulties, again refused to pay.They sent me forms to complete and sign 'Notice of Discontinuance'. I threatened them by going to the Ombudsman, they replies that I should close the case with LLoyds if my intention is to go to the ombudsman.Is this tight? Need some help please.

  • My partner has been trying to reclaim over £3000 of bank charges for nearly 2 years - he has now heard from the Ombudsman that as the bank have advised them they have not received a financial statement from him there is no more they can do. My partner had spent years trying to get the bank to help him to manage his ever increasing overdraft (brought about partly due to ridiculously high charges, often in excess of £150 a month ) - he has also claimed financial hardship (divorce, raising children alone, and now redundancy) but this has cut no ice - if I was a cynical person, I would almost think the Ombudsman has been nobbled. We have more or less given up the fight now. Not sure where he can go with this anymore.
  • Hi All, good luck with your claims. We had a letter of offer from Lloyds for incorrect charging of PPI, saying the claimed amount will be paid in full plus interest within 28 days. That was 4 MONThS AGO . 28 phone calls later and still no closer to getting the money. Any advice on further action would be wellcomed.

    If it were me, I would write to their CEO informing him you are still waiting and that your money is now 3 months overdue therefore the sum payable has increased due to interest and for your time taken to try and finalise the matter and for the cost of postage and alll those phone calls.

    Tell him that you feel you are not being treated fairly and that you seem to be doing all the work and also that it would appear his bank is not honouring promises made. Enclose a copy of their letter promising full payment plus interest and give details of all phone calls made including who you spoke to and what they said. Ask him to give the matter his urgent attention and ask for his reply within 14 days.

    Don't give up. Was he asked for a financial statement by the bank?
    If so, did he supply one? If not, tell the Ombudsman.
    Do this straight away. It could be this statement could be crucial to their decision. Has the Ombudsman closed your case based on what the bank is saying about the statement?
