Sent a hardship letter to HSBC a couple of weeks ago to try and claim my charges in excess of £2000. So far not had a reply but tried to view my account balance today at the ATM machine and received a message saying that my card had been retained. As it is a joint account and my card needed activating, I decided to try my husbands card and the same thing happened again. As I was also overdrawn due to their charges they have recently been ringing us up regularly and over the past couple of days this has stopped so I am now assuming that I will receive a letter off them shortly. Has anyone else experienced anything similar?
    Thanks.
  • hi all,
ive just taken on reclaiming for a friend, original amount was £738without intrest.after getting a phone call from lloyds, they agreed she was in financial difficulty, just after this came the letter about the ruling, and she would be getting nothing.after reading info from the site,i decided to take it up,and wrote a letter threatening to go to the ombudsman.surprisingly, she got a phone call from lloyds offering £240.although a step in the right direction,it does make me wonder,if people are in financial difficulty, why do they try to get them on the cheap?
    good luck with claims.great site:cool:
  • halifax, £897.80 claimed from 2006 to present with interest on your calculator claimed 20th dec 2011 recieved in my bank £80.00 on 31st dec 2011 then 3rd jan 2012 letter saying they tried to ring me and they put 2011 charges back to me hence the £80 in my bank and have reversed the £70.00 charges due this month and will not place any more bank charges until 1st july 2012 I know its not as much as I wanted but its been a huge help to me I claimed on hardship,
  • I have tried to reclaim bank charges of £531 from Abbey which were imposed when I went just over £4 overdrawn. I wrote to them in November and received a reply just before Christmas. I'm a reasonably intelligent person but have no idea what this letter says. It refers to a court case in which Justice Andrew Smith said a few things about overdraft charges. I've concluded it means they won't be paying back. Has anyone else had this letter? Is it worth continuing with my claim? Thanks.
  • i have today after sending a letter to the TSB stating that i'd be carrying on my claim with my account charges by going down the hardship route, received a reply from them,

the letter states that i have no claim against them, as all there charges for unarranged fees are fair!
yet they have made a good will repayment to my account for £728 :) (happy news)
these are charges that was made to my account between october 2007 to march 2008
yet i stated that i was putting a claim in for £2816.04 this was the charges that i recieved over a 6year period, i have since recieved further charges to my account since putting my original claim in,
TSB state that this letter is a final reply.
so, i was wondering if any of you lot out there, have any advice??
and is it still worth pushing for this claim by going to the financial ombudsman?
has anyone had any luck by taking there hardship claim to the financial ombudsman?
    any advice would be great,
    thanks all
  • I made an application ref to being missold payment protection with two closed loans I had dating back from 2006 and 2008. I received an offer letter on 11th Nov 2011 and was paid £3,200 on 2nd December. Lloyds had refunded the money into a lloyds account that i do not use and did not write to me stating they had paid me. I just happened to be looking online in that account today and nearly had a heart attack when I say the money had been paid and was sitting there well before xmas..For the past 1 week I have been calling and emailing them daily as to the whereabouts of the monies promised . They had no information that they had already paid me out. bad communication from their part. I am so happy to have been paid out! I have now logged a claim against my two credit cards with LLoyds tsb and a mortgage I have with the old Abbey national (now Santander) RESULT: fingers and toes crossed for the other pending cases . Pursue peeps.. it is well worth it

Your letter will be referring to the High Court Ruling of 25th November 2010 in which Mr Justice Andrew Smith decreed that bank charges were not unfair.

However, "£531 from Abbey which were imposed when I went just over £4 overdrawn" seems a bit of a hefty charge to me.

Are you sure it was for being only £4 overdrawn. Was it a one off charge?
