  • I wonder if anyone can give me some guidance. Two weeks ago I wrote to the Halifax requesting repayment of bank charges for the last 4 years, using the hardship approach. On Wednesday, I got a phone call from the Halifax on my mobile (more to come on this), saying that they were not going to refund my charges as they were legal at the time (depends on your point of view I suppose...) Following this I have sent another letter to the Halifax, however I have realised that the mobile number I was called on is a brand new number, and I closed my account with the Halifax in December 2010...

    Now, my questions are: 1) Should the bank be phoning you on your mobile to speak to you and tell you that the claim is unsuccessful, should this not be by letter? 2) How did the Halifax get hold of my new mobile number? Is it even legal for them to obtain this if I haven't given it to them?

    I phoned the Halifax's customer services and the first person I spoke to was convinced that it was a scam, however when I told her that the person had spoken to earlier had my account number, and could quote the date on the letter, they went quiet and suggested that I contact my local branch. I then phoned my local branch and spoke to them, they had no record of my mobile number, and going by the fact that they quoted my account number then they are 99% sure it was the Halifax, as opposed to a determined scammer who was able to intercept a letter, and luckily had my brand new mobile number as well.

    Any advice about what to do?
  • Hi can someone answer my question re a claim for hardship in relation to my abbey accounts.

    I was made redundant in may and have not had any luck securing employment, I also am in the process of going through a divorce which I have to find 30k to buy my wife out of our property, but that is another matter.

    Currently, I have £4,000 in savings which I am using to cover monthly expenses. I also have redundancy insurance which covers my mortgage until next july and I rent two of my spare rooms. I have approx £10k of unsecured debt on two credit cards. Naturally the best solution is to get a job, but in the current climate it is proving challenging.

    With this broadly being my financial situation, given that I am unemployed and going through a costly divorce do I have grounds to ask for 6 years charges back from abbey.

  • So, after writing my second letter to santander trying to get more charges refunded, i checked my bank today (my birthday) and found they have refunded me another 100 pound which as you can imagine is a LOVELY birthday prezzie for me :D

    Very pleased, still not wat i wanted but still helped A LOT!

    Amount Reclaimed: £1553
    Amount they paid: £375


    After sending the template letters and following the simple instructions, Llloyds TSB sent me a letter saying that there is no reason why they should give me any money back, but refunded any charges from Jan 2010 to Jan 2011 (Good will maybe?). I won't settle for that, if they're willing to pay thatg much without any real pressure then i'm sure i can push for more. Anyone know the best/most successful way of going about this?

  • Hi i have over £4000 worth of charges with Lloyds Tsb which have sent been passed onto Allied international credit. It has totally left me unable to pay this charges and i am looking to start the procedure of claiming them back. i have read many threads on here and searched the whole site for tips etc but keep coming going around in circles can anybody that has had success point me in the right direction please?

    If it's credit card charges of more than £12 a time you can always use the Office of Fair Trading statement 2006 as your arguement. Bank account charges are harder because of the latest ruling. If, however, you can prove hardship, the Ombudsman route might be the way?

    That's what I'm doing at the moment.

    I might be wrong about this but I think you had to be having difficulties at the time the charges started being taken from your account as well as having difficulties, which you obviously are, now.
    However, it's worth a go, you've nothing to lose. Just study the
    MSE closely, there is a lot of relevent infor. on there, it's a case of
    sifting out what you need for your circumstances.

    I would start by looking at the first template letters on MSE to start the ball rolling.
    1) Request all your data held on file etc (don't ask for actual statements as they will cost a fortune) Normally there is a £10 fee for all your data inc.charges etc.
    2) When you've worked out all your charges request repayment of the charges as advised by MSE. The site is a mine of information. Read it all through and act on the advice.

    Don't forget to speak to the debt collectors, don't ignore them, they won't go away. If you are genuinely broke sometimes £1 a month has been known to work temporarily to keep the 'big bad bailiff' from the door.
